UPON the annexed Affirmation of Martin Russo, Esq., dated September 10, 2021, and the
exhibits annexed thereto, and upon all prior pleadings and proceedings had herein, it is hereby:
ORDERED, that Defendant Zarina Burbacki and her counsel show cause at the Supreme
Court of the State of New York, County of New York, before the Honorable Andrew Borrok,
J.S.C., at Part 53, at the Courthouse located at 60 Centre Street, New York, New York 10007 on
or before the ___ day of September, 2021, at __:__ o’clock in the _______________, or as soon
thereafter as counsel can be heard, why an order should not be made and entered herein granting
Plaintiff’s motion to compel production of documents pursuant to CPLR 3124; and for such other
and further relief as to the Court may seem just and proper.
SUFFICIENT CAUSE BEING ALLEGED, it is ORDERED that service of a copy of
this Order to Show Cause, and all supporting papers upon which same is based, by electronic filing
and email to Defendant’s counsel, on or before September __, 2021 shall be deemed good and
sufficient service; and
It is further ORDERED that answering papers, if any, in response to this Order to Show
Cause shall be served on or before September __, 2021; and
It is further ORDERED that Plaintiff shall serve reply papers, if any, on Defendant by
September __, 2021.
