Texas Board of Architectural Examiners, and Cathy eed: Hendricks, Executive Director, in the Travis County District Cou: Judicial District, Travis County, Texas. é Rogniguecivencoza, Dear Judge Triana-Doyle: Bi a a The Texas Board of Professional Engineers (Board) remains very suppoltive oft as the action being taken by Texas Society of Professional Engineers (TSPE) in this lawsuit against the Texas Board of Architectural Examiners (TBAE). The Board maintains that engineers have the authority to design buildings without engaging an architect provided they have the appropriate education, training and experience. Section 1051.601 provides engineers a wholesale exemption from the TBAE's statute and rules. The fact that the Architecture Board must apply the statutory exemption for engineers does not give the Architecture Board the authority to define what constitutes the practice of engineering. The Board of Professional Engineers is vested with the exclusive jurisdiction to administer and enforce the Engineering Practice Act and determine what constitutes the practice of engineering under that act. The Board further maintains it is the only appropriate authority to discipline engineers engaged in any aspect of engineering, including building design, if so warranted.
