PLEASE TAKE NOTICE that on June 7, 2011, at 1:30 p.m. in Department 220 of the
Superior Court of the State of California, County of San Francisco, located at 400 McAllister
Street, San Francisco, California, Defendant Hennessy Industries, Inc. (“Hennessy”) will move
this Court for an order pursuant to California Code of Civil Procedure Section 2033.280 that
matters in Request for Admissions, Set One, be deemed admitted by Plaintiff Rufus Alexander
(“Plaintiff”). Hennessy also moves for imposition of discovery sanctions pursuant to California

Code of Civil Procedure Section 2033.280(c) in the amount of $900.00, The motion is made on

the grounds that the Request for Admissions is relevant to the subject matter of this action, and
that Plaintiff has failed to serve responses.

The motion is based on this Notice of Motion, the Memorandum of Points and
Authorities, the Declaration of Kurt E. Gilabert, as well as all papers, records and other
documentary evidence on file, deemed on file, or may be submitted at the time this Motion is
