Middlecrest Crossing Senior Apartments et al Index #EF005129-2021 Dear Honorable Judge Hyer: This office represents the Plaintiff in the above matter, and we are writing to request an adjournment of the presently scheduled virtual Conference on August 29, 2022, at 9:30 am. This request is made with the consent of defendants’ attorney Mike Kestenbaum. The reason for the request is because my office has a scheduling conflict and only became aware of same when defense counsel in another matter reached out this morning. As a result, we are short an available attorney and respectfully ask that the Conference be moved to a later time or a different day. Should the Court be inclined to grant the adjournment, Mr. Kestenbaum has advised of his availability on Monday afternoon, Tuesday afternoon, Wednesday morning, Thursday morning or Friday morning next week and we are agreeable to the stated times. My apologies for the belated request that is occasioned by the above circumstances as I am aware of the Court’s rule requiring a request for adjournment be made at least two (2) days before.
