DECLARATION OF PLAINTIFF'S ATTORNEY IN SUPPORT
OF EXPARTE APPLICATION FOR ORDER THAT SERVICE OF SUMMONS AND
COMPLAINT ON DEFENDANT BE MADE BY POST AND MAIL
I, DAVID J. FORAN, declare as follows:
1. Iam an attorney at law, duly licensed to practice before all the Courts of the State of
California, associated with the LAW OFFICES OF JOSEPH A. SACRAMENTO, ESQ.,
attorneys for plaintiff in the above entitled action.
2. The complaint in this action, which is for unlawful detainer was filed on October 1, 2012,
and the summons was duly issued on October 1, 2012 and amended thereafter on October 3, 2012 to
correct a typographical error.
3. Pursuant to the allegations in the complaint, plaintiff has the authority to sue as the real
party in interest pursuant to a contract with the trustees of the LOWE HONG TRUST the owner
of the premises located at 1115 Taylor Street, #4, San Francisco, California 94108. This is an
action for unlawful detainer for non-payment of rent. Plaintiff seeks to recover possession of the
premises and unpaid rent.
4. Defendant AARON WILLIAMS is a necessary party to this action. Said defendant
cannot, with reasonable diligence, be served in any other manner specified by Sections 415.10 and
415.20 of the California Code of Civil Procedure. Defendant’s business address is unknown, however
defendants’ residential address is the subject property located at 1115 Taylor Street, #4, San
Francisco, California 94108 and plaintiff has used due diligence in serving defendant at the subject

premises, a reasonable search of public records does not disclose any other address for said defendant;
hence, said defendant’s whereabouts are unknown.
5. Reasonable diligence in attempting service is set forth in the Declaration of GREGORY
BROWN on file herein and attached hereto.
6. Plaintiff prays that the Court issue it's order directing service of the summons against
Defendant AARON WILLIAMS by posting of the summons at1115 Taylor Street, #4, San
Francisco, California 94108, pursuant to provisions of Section 415.45 of the California Code of
Civil Procedure and mailing a copy of the Amended Summons and Amended Complaint to
defendant’s home address at 1115 Taylor Street, #4, San Francisco, California 94108.
I declare under penalty of perjury under the laws of the State of California, that the foregoing is
