Proposed Order adding Nostrand Mezz Lender LLC as a party defendant and amending the caption
has been uploaded to NYSCEF and forwarded to Ms. Lazzaro by email. The undersigned provided
a copy of the Proposed Order to counsel on September 30, 2022. Counsel for Nostrand Mezz
Lender LLC refuses to either confirm her agreement with the draft Proposed Order sent to her or
to request revisions to the draft Proposed Order, and instead seeks to pretend that the Court never
granted the plaintiffs’ Motion on the record at the hearing on September 19, 2022.
