PLEASE TAKE NOTICE, that upon the Affidavit of Joshua B. Zegen in Support of
Motion to Dismiss, dated August 10, 2021 and the exhibits annexed thereto, the Memorandum of
Law in Support of the Motion to Dismiss Plaintiffs’ Verified Complaint dated June 8, 2021, and
all of the papers and proceedings had and filed heretofore herein, the defendants, MADISON
REALTY CAPITAL, L.P., JOSHUA B. ZEGEN, MARK GORMLEY, 1580 NOSTRAND
AVENUE LLC, 1357 FLATBUSH AVENUE 1 LLC, BROOKLYN THREE LLC, MRC RE
HOLDINGS II LLC, 271 LENOX LENDER LLC, and FULTON STREET LENDER LLC by
and through their attorneys Kriss & Feuerstein LLP, will move this Court before an IAS PART
TO BE DETERMINED, at the Supreme Court of the State of New York, County of Kings,
located at 360 Adams Street, Brooklyn, New York on September 2, 2021 at 9:30 a.m., or as soon
thereafter as counsel may be heard, for the entry of an Order:
1) dismissing Plaintiff’s Verified Complaint filed in this action on June 8, 2021, with
prejudice pursuant to CPLR 3211(a)(1); 3211(a)(3); 3211(a)(5) and 3211(a)(7); and
2) Granting such other and further relief as to the Court may seem just and proper.
