NOTICE IS HEREBY GIVEN, that an action has been commenced and is now pending in the
Supreme Court of Cayuga County upon the Complaint of the above named Plaintiff against the above
named defendants for the foreclosure of a mortgage dated November 24, 2004, executed by Arthur J.
Carnicelli and Mary Ann Carnicelli to secure the sum of $88,125.00. The Mortgage was recorded at
Book 2115, Page 159 in the Office of the Cayuga County Clerk on December 6, 2004. The mortgage
was subsequently modified on February 18, 2008. The mortgage was subsequently modified on June 21,
2010. The mortgage was subsequently assigned by an assignment executed December 9, 2011 and
recorded on December 13, 2011, in the Office of the Cayuga County Clerk at Book 130, Page 16. Said
Mortgage was subsequently modified by a Loan Modification Agreement executed by Arthur J.
Carnicelli and Mary Ann Carnicelli on June 13, 2012 and recorded October 22, 2012 in Book 3058,
Page 46 in the Office of the Cayuga County Clerk.
AND, NOTICE IS FURTHER GIVEN, that the mortgaged premises described in such
mortgage(s) affected by the foreclosure action, were, at the time of the commencement of the action, and
at the time of the filing of this Notice, situated in Cayuga County, New York, and are described in

Schedule A - Legal Description
All that tract or parcel of land situate in the Town of Aurelius, Cayuga County, New York State, being
the south 130 feet of filed Map DD-31 which is also described as follows:
Beginning at the northwest corner of the lands of Andrew Hickey, Book 994 of Deeds, and Page 246
said point being the northwest corner of Lot 1 of filed Map DD-31 which is on the east line of Mullen
Drive a distance of 1087.2 feet north from the centerline of Clark Street Road.
Thence North 06 degrees 00 25 W, along the east line of Mullen Drive, a distance of 130.00 feet to the
lands of James and Gloria Flanders, Book 363 of Deeds, Page 810.
Thence N 83 degrees 59 35 E, along the lands of Flanders, a distance of 132.00 feet to the line between
the Town of Aurelius and the City of Auburn.
Thence S. 06 degrees 00 25 E, along said City & Town line, a distance of 130.00 feet to the lands of the
aforesaid Hickey.
Thence S 83 degrees 59 35 W, along the lands of Hickey, a distance of 132.00 feet to the point of
beginning.
All bearings are based on magnetic North 2002 and alldistances are level. Reference is made to a survey
and map prepared by Watkins Land Surveying, PLLC, dated June 3, 2002.
