DANA CORPORATION’s (nka DANA COMPANIES, LLC) (hereinafter “DANA”)
primary argument is that plaintiff did not have leave of Court to file the Amendment to the
Complaint which named DANA in substitution for a DOE defendant.
Plaintiff's counsel has a long history of resolving any pleading issues with defendant
DANA short of formal motion practice. DANA and plaintiffs counsel have routinely and
frequently agreed to waive the intentional tort and punitive damages portions of asbestos
complaints, Plaintiff is still willing to dismiss the punitive damages claims against DANA.
In reliance upon the long-standing understanding between plaintiffs’ counsel and

of which DANA now complains. ,
According to Brown & Weil's California Practice Guide: Civil Procedure Before Tnal
(The Rutter Group 2007) at { 6:617, "Defective substitution of fictitious defendants is a
procedural error and can be cured by amendment prior to trial, Indeed, absent prejudice to
defendant, the court has no discretion to refuse such amendment. (Streicher v. Tommy's Elec.
Co, (1985) 164 Cal. App.3d 876, 884-885)."
DANA has made no showing of any prejudice.
Thus DANA’s Motion to Strike should not be granted without leave to amend.
