& Paul, LLP (collectively, the “Claimants”), to prosecute their claims in their respective state
court actions against the Debtor;

of Debtor’s liability insurers who agree to pay any claimant’s claim, in whole or in part,

c. to allow any Claimant who is adjudicated to be entitled to judgment in
his or her favor against Debtor to seek to enforce any such judgment by prosecuting to
judgment an action under Cal. Ins. Code § 11580(b) against any one or more of Debtor’s
ability insurers; . :

d. to allow any of Debtor's liability insurers to pay all or part of the costs of
(i) defending any state court action against Debtor, even if under that insurer’s policies defense
costs erode the limits of lability, (ii) settling any state court action against Debtor, and (iii} any
judgment entered against Debtor or the insurer; : |

2. ‘hat any judgment obtained in a state court action may not be enforced against
any assets of the Debtor other than its liability insurance;

3. That any decision, findings of fact, or other determination in the state court
action shall not be binding on the bankruptcy estate and shall not be res judicata ér have any
collateral estoppel effect on the bankruptcy estate;

4, That any claimant who wishes to file a suit against Debtor that was not pending
on the Petition Date must in order to effect service on the Debtor: (a) file a notice. on the docket |
of this bankruptcy case advising that a new suit has been filed against Debtor, and attach a copy
of the summons and complaint to the notice, and (b) serve a copy of the summons and
complaint on Kenneth B, Prindle, Esq, Prindle, Amaro, Goetz, Hillyard, Danes b Reinboltz
LLP, 310 Golden Shore Pkwy 4th floor, Long Beach, CA 90802; {

5. ‘That nothing in this Order shall be deemed to make any ruling or decision
whatsoever regarding whether any insurer who issued liability insurance coverage to Debtor is
or is not obligated to pay any particular Claifnant’s claim under that insurer’s policies or

applicable law; and
