Defendant LAMONS GASKET COMPANY (hereinafter referred to as "LAMONS') herein submits the following motion in limine for an order excluding evidence consisting of parts of lungs, or photographs or slides of Lungs. I INTRODUCTION Based on defense counsel’s experience in other cases, Lamons anticipates that plaintiffs’ counsel in this action will attempt to offer into evidence actual preserved lungs, or photographs or slides of lung tissue. There is no purpose behind these forms of evidence other than to provoke horror and inflame the jury. Accordingly, defendant asks that this Court exercise its discretion and preclude introduction of such evidence. LEGAL ARGUMENT A. Evidence of Actual Diseased Lungs or Graphic Photographs of Such Lungs are Inflammatory and Serve No Purpose Other Than To Unduly Prejudice Lamons. This Court is empowered to grant this motion on the basis of Evidence Code section 352 which affords the Court the discretion to exclude evidence if its probative value is substantially outweighed by the probability that is admission will create a substantial danger of undue prejudice and of confusing the issues. There is no evidence that any such slides, pictures or samples bear any resemblance to, or relation with, the actual disease being discussed in the instant case. There is no evidence that any such ‘evidence’ accurately portray what they are meant to portray. Moreover, if, by chance, plaintiffs counsel intends to present ‘evidence’ taken from plaintiff himself, such evidence would also be highly prejudicial. Such evidence is completely unnecessary to prove any essential fact in the case at hand. iil. CONCLUSION For all of the foregoing reasons, Lamons motion in limine for an order precluding plaintiffs from introducing into evidence actual human lungs, or graphic photographs of lungs, or slide tissue from lungs should be granted.
