Relief Requested: An Order and Judgment pursuant to CPLR Section
5225(b) requiring all Respondents except Lucky
Corner Realty, LLC (hereinafter “Lucky Corner”)
to make or continue to make all payments to the
Sheriff of the County of Onondaga of all rental
amounts due, past due and/or to become due to
Respondents Lucky Corner, directly or to any other
party directed to be paid by Lucky Corner, pursuant
to said Respondent’s rental leases, month-to-month
written, verbal and/or other agreements to pay lease
or rental payments to Lucky Corner, through and
including the end of such leases or agreements,
including extensions, renewals and month-to-month

holdovers, relative to any and all real properties
owned by Lucky Corner, upon the grounds set forth
herein and further, pursuant to CPLR 5210,
punishing any Respondent failing to comply with
contempt of court and, furthermore granting to
Petitioner The City of Syracuse, such other and
further relief as to which this Court may deem just
and proper.
Answer: Pursuant to Section 403(b) of the New York Civil
Practice Law and Rules (CPLR), since this Notice
of Petition and Petition with exhibits is served at
least twelve (12) days before the hearing date,
Respondent’s Answer and Supporting Affidavits,
if any, shall be served at least seven (7) days
before the hearing date.
