property which is the subject of the Action of Mortgage Foreclosure and you must occupy the
property which is the subject of this Action.of Mortgage Foreclosure as your principal residence.
You will discuss your mortgage foreclosure with an independent and professional Housing
Counselor who will work with you to review your finances and work with your lender to try and
resolve the mortgage foreclosure action. The Housing Counselor is available to you AT NO
CHARGE. Once you call this number, the Housing Counselor will contact the lender’s attorney
and the Court sanctioned thirty (30) day delay of the Action in Mortgage Foreclosure will go into
effect, all you have do is eall.
You can haye the Action of Mortgage Foreclosure delayed for up to thirty (30) days so that
you can participate in a conference with your Housing Counselor and submit a loan resolution
proposal to the lender and their attorney. This may assist you in saving your home from
foreclosure.

COMPLAINT IN MORTGAGE FORECLOSURE
1. Plaintiff is Caliber Home Loans, Inc., duly organized and doing business at the
above-captioned address.
2. The Defendant is Todd Harris Thykeson a/k/a Todd H. Thykeson, who is amortgagor
Thykeson 22-101804 Complaint in Mortgage Foreclosure Page 2 of 5and real owner of the mortgaged property hereinafter described, and his/her last-known address is
1011 Brook Avenue, Secane, PA 19018.
3. The Defendant is Bobbi Ann McDowell a/k/a Bobbi A. McDowell, who is a
mortgagor and real owner of the mortgaged property hereinafter described, and his/her last-known
address is 1011 Brook Avenue, Secane, PA 19018.
4, On April 24, 2019, Todd Harris Thykeson a/k/a Todd H. Thykeson and Bobbi Ann
McDowell a/k/a Bobbi A. McDowell, made, executed and delivered a Mortgage upon the premises
hereinafter described to Mortgage Electronic Registration Systems, Inc., as nominee for Mortgage
Research Center, LLC dba Veterans United Home Loans which Mortgage is recordéd in the Office
of the Recorder of Delaware County as Instrument Number 2019020165 (“the Mortgage”), the
Mortgage is incorporated herein by reference pursuant to Pa.R.C.P. 1019(g).
5. On April 24, 2019, Todd Harris Thykeson a/k/a Todd H. Thykeson and Bobbi Ann
McDowell a/k/a Bobbi A. McDowell, also executed a promissory note secured by the Mortgage (“the
Note”). Plaintiff, directly orthrough an agent, is in possession of the Note and is the holder of the
Note with the right to enforce it; the Note is either made payable to plaintiff or has been duly
indorsed.
6. On May 13, 2022, the Mortgage was assigned by Mortgage Electronic Registration
Systems, Inc., as mortgagee, as nominee for Mortgage Research Center, LLC d/b/a Veterans United
Home Loans, its successors and assigns to Caliber Home Loans, Inc., by assignment of mortgage,
recorded in the Office of the Recorder of Delaware County as Instrument Number 2022030043, said
assignment of mortgage is incorporated herein by reference pursuant to Pa.R.C.P. 1019(g).
7. The premises subject to the Mortgage is described in the legal description attached as
Exhibit “A” and is known as 1011 Brook Avenue, Secane, PA 19018.
8. The Mortgage is in default because monthly payments of principal and interest upon the
Thykeson 22-101804 Complaint in Mortgage Foreclosure Page 3 of SMortgage due July 1, 2020 and each month thereafter are due and unpaid, and by the terms of the
Mortgage, upon default in such payments for a period of one month, the entire principal balance and
all interest due thereon are collectible forthwith.
9. The following amounts are due on the Mortgage:
Principal Balance $ 211,478.26
Interest through September 11, 2022 $ 23,507.21
(Plus $28.25 per diem thereafter)
Late Charges $ 728.16
Escrow Advance $ 17,661.95
Title Fees $ 325.00
Property Inspections $ 180.00
GRAND TOTAL $ 253,880.58
plus additional interest and all other amounts authorized under the mortgage and applicable law that
are reasonable and have been incurred, including but not limited to costs, escrow advances, and
attorney's fees.
10. Pre-foreclosure notices were sent at least 33 days prior to the filing of this action.
Copies of said notices are attached hereto as Exhibit “B”.
WHEREFORE, Plaintiff demands in rem Judgment against the Defendants in the sum of
$253,880.58, together with interest accruing thereafter; other costs and charges collectible under the
Mortgage and applicable law, including all reasonable and actually incurred attorney's fees and
costs; and the foreclosure and sale of the mortgaged property.

To apply, you must have a face-to-face meeting with a HEMAP-approved Consumer Credit
Counseling Agency within 33 days of the date of this notice. This meeting is free and is the-only
way to apply for HEMAP. A list of approved Counseling Agencies is attached. A list is also
available at http://www.phfa.org/counseling/hemap.aspx. If after speaking with a Counseling
Agency you have further questions about HEMAP, please call 1 (800) 342-2397. Individuals with
hearing impairment may call 711 (RELAY).
To make sure you meet the deadline, please call a Counseling Agency immediately to
schedule a face-to-face meeting. Keep this entire Act 91 Notice, including the attached Account

A counselor can:

Even if you miss the deadline, you may still apply for HEMAP, but a late HEMAP
application will not stop your lender from foreclosing. However, if your application is approved, a

also temporarily help you make future mortgage payments.
Alternatively, you may save your home from foreclosure by curing your default. That means
paying your lender all amounts currently due, including reasonable late charges, attorney fees and
other costs and by otherwise fulfilling your mortgage obligations. You may cure the default at any
time up to one hour before a Sheriff's Sale, up to three times in any calendar year.

Save Your Home From Foreclosure
This is an official Act 91 Notice. You are receiving this notice because Pennsylvania law
requires mortgage lenders to send it to homeowners facing foreclosure. This notice contains
important legal information about your rights and how you can save your home. YOU MAY BE
ELIGIBLE FOR STATE FUNDED ASSISTANCE from the Homeowner’s Emergency
Mortgage Assistance Program (HEMAP), a program of the Pennsylvania Housing Finance Agency
(PHFA).
CALL A COUNSELING AGENCY FOR A MEETING.
APPLYING FOR HEMAP MAY TEMPORARILY STOP A FORECLOSURE ACTION.
To apply, you must have a face-to-face meeting with a HEMAP-approved Consumer Credit
Counseling Agency within 33 days of the date of this notice. This meeting is free and is the only
way to apply for HEMAP. A list of approved Counseling Agencies is attached. A list is also
available at http://www.phfa.org/counseling/hemap.aspx. If after speaking with a Counseling
Agency you have further questions about HEMAP, please call 1 (800) 342-2397. Individuals with
hearing impairment may call 711 (RELAY).
To make sure you meet the deadline, please call a Counseling Agency immediately to
schedule a face-to-face meeting. Keep this entire Act 91 Notice, including the attached Account
Summary, and have it available for your face-to-face meeting, whether done in person or remotely.
A counselor can:
Help you apply for HEMAP and explain how the program works.
Talk with your lender about.a loan modification or other repayment plan.
¢ Explain possible options to avoid foreclosure such as loss mitigation, refinancing your loan,
selling or transferring your property to a third party or having a third party cure the
delinquency on your behalf through a short sale or assumption of mortgage.
Provide referrals for other assistance, programs or services.
Explain other rights you may have, including your right to assert the non-existence of the
debt and any other defenses you may have.
Even if you miss the deadline, you may still apply for HEMAP, but a late HEMAP
application will not stop your lender from foreclosing. However, if your application is approved, a
HEMAP assistance loan will bring your mortgage current and stop the foreclosure. HEMAP may
also temporarily help you make future mortgage payments.
Alternatively, you may save your home from foreclosure by curing your default. That means
paying your lender all amounts currently due, including reasonable late charges, attorney fees and
other costs and by otherwise fulfilling your mortgage obligations. You may cure the default at any
time up to one hour before a Sheriff's Sale, up to three times in any calendar year.
If you have filed a petition in bankruptcy, this notice is provided for informational purposes
only and is not an attempt to collect a debt. If you are protected by a bankruptcy filing you may still
apply for HEMAP assistance.
