FILED: NEW YORK COUNTY CLERK 04/04/2019 01:34 PM INDEX NO. 655446/2017 NYSCEF DOC. NO. 118 RECEIVED NYSCEF: 04/04/2019 SUPREME COURT OF THE STATE OF NEW YORK NEW YORK COUNTY PRESENT: HON. ANTHONY CANNATARO PART IAS MOTION 41EFM Justice --------------------------------------------------------------------------------X INDEX NO. 655446/2017 ALLISON CLARK, MOTION DATE 03/24/2019 Plaintiff, MOTION SEQ. NO. 005 -v- CASTOR AND POLLUX LIMITED LIABILITY COMPANY, SEAN NICHOLAS, JUSTIN DEDEMKO DECISION AND ORDER Defendant. ---------------------------------------------------------------------------------X The following e-filed documents, listed by NYSCEF document number (Motion 005) 88, 89 were read on this motion to/for SUBST/RELIEVE/WITHDRAW COUNSEL . This “motion” to withdraw is denied. Defendants’ counsel apparently e-filed a proposed order to show cause seeking to withdraw as counsel on October 26, 2018, however, it does not appear that I or any other Justice of this Court signed the proposed order. Notwithstanding the foregoing, oral argument was scheduled on this Court’s calendar for January 23, 2019. Counsel for defendants did not appear on that date. Given that no motion to withdraw was properly before the Court to begin with, coupled with movant’s failure to appear on January 23rd, this motion is now denied without prejudice to defendant counsel’s presenting a properly noticed motion to withdraw. Accordingly, it is ORDERED that the motion to withdraw is denied. 4/4/2019 $SIG$ DATE ANTHONY CANNATARO, J.S.C.
