PLAINTIFF/PETITIONER: Daniel Moraru CASE NUMBER: DEFENDANT/RESPONDENT: Keith Kelly, Hill & Co. Property Mgmnt Inc. CSM - 13-8 4467 4 DECLARATION (This form must be attached to another form or court paper before it can be filed in court.) SC-100, Item 3 I, Daniel Moraru, was leasing apartment at 2603 33rd Ave #204 from 10/01/2010 to 7/14/2013. The final move-out inspection of the vacated apartment occurred on 7/14/2013. During the move-out inspection the following people were present: Resident Manager, myself and my spouse. The inspection was concluded and the Resident Manager didn't identify or point out any issues or damages in the apartment. On 7/25/2013 Hill & Co. Property Management issued a security deposit refund check but the following amounts were withheld - $100 for cleaning and $643.64 for repainting (calculated as 40% of $1,609.11 that Hill & Co. spent on repainting the whole unit). The original security deposit was in the amount of $3,443. Having received the check on 7/27/2013, I have immediately notified Hill & Co. Property Management in writing that there is a problem - the leased apartment was returned in normal condition (considering the normal wear and tear over 2 years and 9 months) as per the move-out inspection and the repainting was not necessary. Over the following 8 days, I have tried to resolve this dispute with Hill & Co. Property Management both over the phone and in writing but ultimately unsuccessfully. Hill & Co. Property Management has maintained the position that the unit required repainting due to damages to the walls and refused to provide an explanation regarding: - why the alleged damages were not identified by Resident Manager during the final move out inspection considering the unit was completely empty of any furniture. - assuming that there were damages, why the presence of the alleged damages wasn't communicated by Hill and Co. either verbally or in writing either at the time of inspection or later. The move-out checklist was not shared by Hill & Co. Property Management either on 7/14/2013 or later. - why Hill and Co. didn't provide an option to examine the alleged damages and perform repairs myself or hire a contractor. Because Hill & Co. Property Management didn't provide either explanation or proof/pictures of the alleged damages and also didn't share an itemized invoice for the repainting of the alleged damages despite receiving the request, I believe that the company acted in bad faith by retaining the portion of security deposit for repainting as well as refusing to refund that portion when requested. That is why I am submitting a claim for: - $643.34 that was wrongfully withheld by Hill & Co. Property Management from the security deposit - $6,886 in statutory damages (double sec. deposit - in accordance with California Civil Code Section 1950.5) | declare under penalty of perjury under the laws of the State of California that the foregoing is true and correct.
