LORENZO DONTE' WOODS
RESPONDENT
NOTICE OF REGISTRATION, FOR ENFORCEMENT ONLY, OF OUT OF STATE
CHILD SUPPORT ORDER
AND COMPLAINT FOR ENFORCEMENT THEREOF BY CONTEMPT AND BY
ISSUANCE OF AN INCOME DEDUCTION ORDER
(@ursuant to the Uniform Interstate Family Support Act, O.C.G.A. § 19-11-100 et seq.)
Comes Now, Petitioner and shows the Court the following:
1. Respondent is subject to the jurisdiction and venue of this Court.
2. The documents furnished by the Initiating State are attached hereto as Exhibit "A"
and incorporated herein by reference in accordance with O.C.G.A. § 19-11-161.
A. Notice of Registration of Out-of-State Child Support Order
Respondent is hereby notified, pursuant to O.C.G.A. § 19-11-164, as follows:
a. Petitioner received a request from the State of NORTH CAROLINA that an existing
child support order from the State of NORTH CAROLINA ordering the payment of
child support for the following child(ren):
CHILD’S NAME BIRTHDATE
LAMAR N WOODS XX/XX/2017
be registered by this Court for the enforcement purposes only.
b. Said out-of-state order was filed with this Court at the same time and date as this
pleading and upon this filing was registered, for enforcement purposes only, pursuant
to O.C.G.A. § 19-11-162 (a).
c. To the best of Petitioner's knowledge and belief, the registered order is the child
support order that must be recognized as the controlling order for enforcement
(O.C.G.A. § 19-11-116). Petitioner asks the Court to confirm by its order that the
registered order is the controlling order (or alternatively to determine which other
existing child support order must be recognized as the controlling order) and to issue ~
findings of fact on which this determination is based.
d. Said order, as of the date of its registration by filing with this Court, is enforceable in
FORMCCU Stars Rewrite DCSS Case No.: 520030839 Revised Summer 2022the same manner as an order issued by a court of Georgia. O.C.G.A. § 19-11-164 (b)
().
e, Respondent may file a request for a hearing to contest the validity or enforcement of
the registered order provided such request is filed within 20 days of the date of this
notice. O.C.G.A. § 19-11-165 (a). Said requests will be heard by the Court at the
same time that this pleading is considered by the Court.
f. Failure of Respondent to request such a hearing in a timely manner will result in
confirmation and enforcement of the registered order and of the alleged arrearage and
will preclude any other contest of the order with respect to any matter that could have
been asserted, O.C.G.A. § 19-11-164 (b) (3), including the amount of alleged
arrearage, O.C.G.A. § 19-11-164 (b) (4).
g. Respondent's child support arrears under the registered order are $1,320.20, as
of 09/01/2022.
h. An income deduction order, in conformity with the registered order, shall be issued
by this Court (unless such order is timely and successfully contested) and sent to
Respondent's employer/payor for said employer/payor to deduct child support
payments from Respondent's income.
i. IfRespondent contests the validity or enforcement of the registered order or seeks to
vacate the registration, Respondent shall have the burden of proving one or more of
the defenses listed in 0.C.G.A. § 19-11-166 (a), or else the Court shall issue an order
confirming the registered order. O.C.G.A. § 19-11-166 (c).
j. Effective as of the date of registration of the out of state order, Respondent's child
support payments shall be made to the Division of Child Support Services, Georgia
Department of Human Services.
B. Complaint for Enforcement of Registered Out of State Child Support Order by
Contempt and by Issuance of an Income Deduction Order
1. Respondent is in arrears as alleged in Part A, Paragraph g, herein.
2. Respondent has willfully failed to obey the terms of the registered order.
3. Respondent is therefore in contempt of said order for which this Court may impose
sanctions as if the registered order was an order issued by a court of Georgia. O.C.G.A. §
19-1 1-162 (b).
4. Petitioner therefore asks the Court to hold Respondent in contempt and to impose
appropriate sanctions.
Wherefore, Petitioner prays for the following relief:
A. That process issue:
B. That the Court confirm that the registered order is the existing child support order that
must be recognized as the controlling order for enforcement, or alternatively to determine
which other existing child support order should be so recognized, and to issue findings of fact
on which such determination is based;
C. That the registered order be enforced by this Court as if it were an order of a court of
the State of Georgia, including holding Respondent in contempt and imposing sanctions;
D. That Respondent make periodic payments toward his child support arrears either as
FORMCCU Stars Rewrite DCSS Case No.: 520030639 Revised Summer 2022already ordered by the registered order or, if no repayment amount has been ordered, in an
amount ordered by this Court as a part of its enforcement of the registered order;
