IT IS HEREBY STIPULATED AND AGREED by and between counsel for the respective parties
as follows:
1. That plaintiff hereby agrees that the IME WATCHDOG representative JORGE ROLON,
who observed plaintiff's defense physical examination conducted by ARNOLD T. BERMAN MD, will
not be called to testify at trial for any purpose (i.e., either as a direct witness or rebuttal witness) and
hereby withdraws plaintiff's motion for a protective order and to quash subpoena currently
returnable December 18, 2019;
2. That defendants hereby withdraws the subpoena duces tecum and ad testificandum
served upon JORGE ROLON of IME WATCHDOG and hereby withdraws the notice to take non party
deposition of JORGE ROLON; and
3. That this stipulation may be executed by an electronic, photocopy and/or facsimile
signatures and same shall be deemed to have the same force and effect as an original signature.
