ORDER
On this day, the Court considered Plaintiff Xtreme Crane & Rigging, LLC’s Motion
for Summary Judgment and Patterson UTI Drilling Company, LLC’s response to said
motion and Defendant Patterson UTI Drilling Company, LLC’s Traditional and No
Evidence Motion for Summary Judgment and Plaintiff Xtreme Crane & Rigging, LLC’s
response to said motion. The Court, having reviewed dueling motions of both Plaintiff
and Defendant, responses and replies thereto, if any, and having considered the
arguments of counsel and the summary judgment evidence, finds that Plaintiff, Xtreme
Crane & Rigging, LLC’s Motion for Summary Judgment is in all things GRANTED and
that Defendant, Patterson UTI Drilling Company, LLC’s motion is in all things DENIED.
It is therefore, ORDERED, ADJUDGED AND DECREED that Plaintiff Xtreme
Crane & Rigging, LLC is entitled to foreclosure upon its liens filed in Karnes County, Frio
County and Reeves County, Texas and sale of Patterson UTI Drilling Company, LLC
equipment within those counties as necessary in order to retire the amount owed to
Plaintiff in the sum of $65,147.50, plus post judgment interest at the rate of 5 percent per
annum from the date of this judgment until paid and attorney’s fees as determined during
subsequent hearing of this Court regarding same.
It is further ordered that all costs of court are taxe against Defendant Patterson
UTI Drilling Company, LLC. In the event that Plaintiff seeks abstract or execution of this
Judgment, Plaintiff is entitled to reasonable attorney’s fees and costs of court incurred via
such process.
It is further ORDERED that Xtreme Crane & Rigging, LLC is allowed such writs
and processes as may be necessary in the collection or enforcement of this judgment.
It is further ORDERED that an oral hearing shall be held in order to determine the
award of equitable and just attorney’s fees to which Plaintiff is entitled as against
Defendant Patterson and shall take place on __________________, 2019 at ________
AM/PM.
