After reviewing the Moving Papers, Opposition and Reply Briefs, the Court rules as follows: Defendant City and County of San Francisco's motion to quash trial subpoena of Jeffrey Bramlett is denied. The City's counsel previously agreed to accept service of the subpoena on behalf of Mr. Bramlett, who is a material witness who signed the City's written discovery responses and a declaration in support of the City's motion for summary judgment. Plaintiff Zhongying Ding is not seeking to reopen discovery or to depose Mr. Bramlett. The City can readily resolve Mr. Bramlett's schedule conflict with the current trial date by accepting Plaintiff's offer to stipulate to a brief continuance of the trial until Mr. Bramlett returns from vacation.
