WHEREAS on March 8, 2013, the Court entered its Order Denying Plaintiff's Motion
for Summary Judgment; and
WHEREAS counsel for Plaintiff has made a request to file a Motion to Reconsider
pursuant to Rule 115.11 by sending a letter to the Court dated April 5, 2013; and
WHEREAS after thoughtful consideration of said letter, the Court concludes that the
constitutionality of the MTSRA and its application to the oral agreement of the parties under all
of the facts of this case, are inextricably intertwined; and
WHEREAS the Court continues to believe that a full factual record is essential before
the Court can make a fully informed decision concerning either the constitutionality of the
MTSRA or its application to the oral agreement of the parties; and
WHEREAS the Court concludes that counsel for Plaintiff has not presented a compelling
reason for the Court to reconsider its prior Order Denying Plaintiff's Motion for Summary
Judgment, and
WHEREAS counsel for Plaintiff has also requested a Scheduling Conference pursuant to
Rule 111.03;
NOW, THEREFORE, the Court enters the following ORDER:
1, Plaintiff's request to file a Motion to Reconsider under Rule 115.11 is hereby DENIED.2. Court Administration shall schedule a telephone Scheduling Conference under Rule
111.03 of General Practice with counsel for the parties, forthwith.
