                  PLEASE     TAKE     NOTICE      that upon   the  accompanying     Verified   Petition of  ARLENE      JOAN     MC   KENNA

         verified  the 22nd  day  of  August.   2022  and   the Affirmation    of FRANK      M.  PELL,    Esq., dated  August    29, 2022,   the

         undersigned will make an application at Supreme Court of the State of New York in the County of Albany, located at the

         Albany County Courthouse, 16 Eagle Street, Albany, New York 12207 on November                     4, 2022, at   9:30 a.m. or as soon

         thereafter as counsel may be heard, for an Order pursuant to Public Officers Law § 84 et al, 10 NYCRR 35.4 et al, Public

         Health   Law   §  4174(1)(b)(1)    and  any  and   all other  applicable   statutes  and  regulations   for  an  Order  directing   the

         Department of Health of the State of New York to :           a.) Amend the birth record of Petitioner’s father Andrew Fracaro,

         born May 14, 1922, to change the name of his Father from “John Fracaro” to “Giovanni Fracaro”; b.) Amend the birth

         record of Petitioner’s father Andrew Fracaro, born May 14, 1922, to change the name of his Mother “Cristeni Carle” to

         “Cristini  Carli”,  and;  c.) issue  to Petitioner  and/or  Petitioner’s   Attorney,  Frank   M.   Pell, Esq.,  6 Crystal   Lake  Rd.,

         Rensselaerville,   New   York   12147   a certified  copy  of  said birth certificate  as amended,    together  with  such  other  and

         further relief as to the Court may seem just and proper.

                  PLEASE TAKE FURTHER NOTICE that, pursuant to CPLR § 7804, an answer and supporting affidavits, if any,

         shall be served at least five (5) days before June 18, 2021.
