I, Spencer Persson, declare as follows:
1. 1 am a partner with the law firm of Norton Rose Fulbright US LLP and am one of
the attorneys of record for Defendant Intellitix, Inc. (“Intellitix”) in the above-captioned matter. |
make this declaration in support of Intellitix’s Motion to Strike Portions of Plaintiff's Class
Action Complaint. I have personal knowledge of the matters set forth in this declaration and, if
called as a witness, I could and would competently testify thereto.
2 On Monday, January 29, 2018, I met and conferred with Adam Tamburelli, Esq.,
counsel for Plaintiff Alexa Parashos, via telephone regarding Intellitix’s grounds for striking all
allegations and claims premised on purported violation of California’s gift certificate statute,
Civil Code section 1749.45 ef seg. | explained that the gift certificate statute does not apply to the
wristbands at issue in this case. The parties did not reach an agreement resolving the objections
raised.
I declare under penalty of perjury under the laws of the State of California that the
