PAGE 1PLEASE TAKE NOTICE that on Tuesday May 29, 2018 at 9:30 a.m. in Department 302 of|
this Court, located at 400 McAllister Street, San Francisco, California, Plaintiff Diamond will and
hereby does move the Court to issue a commission authorizing an out of state subpoena in
accordance with Code of Civil Procedure Section 2026.010(f).
Code of Civil Procedure Section 2026.010(f) requires this Court to issue a commission
authorizing the deposition in another state when requested. Plaintiff requests that the Court issue a
commission authorizing the deposition of third party witness Emily Bushaw to occur in Washington
State.
This Motion is based upon the supporting Memorandum of Points and Authorities, the
Declarations of Plaintiffs counsel Anne Costin, the Declaration of Plaintiff Ilana Diamond, as well
as the pleadings, records and files herein, and upon such other and further oral and/or documentary
evidence as may be presented at the time of the hearing of this Motion.
