April 2015, Plaintiff’s Motion for Default
Judgment coming before the Court in the above titled matter. Plaintiff appears by its attorneys of
record. There are no other appearances.
The Court being duly advised makes the following findings:
1. That the Plaintiff in this action filed its petition on or about June 3, 2013.
2. That Defendants Tony L. Jones, was legally served on June 17, 2013, by the
Sheriff of Cass County Missouri.
3. That Defendants Tony L. Jones should have filed a respective answer to
Plaintiff’s petition by July 17, 2013.
4. That Plaintiff respectfully requests the Court, under Missouri Rule of Civil
Procedure 74.05, enter a Default Judgment against the Defendants in this cause for Defendant’s
failure to file an Answer, or any pleading.
5. That the Plaintiff is due the principal sum of $54,144.58, plus continuing interest
at the contract rate of 5.6250% from February 13, 2013, as stated in the Affidavit attached to
Plaintiff’s Motion for Default Judgment, plus attorney fees in the amount of $2,500.00, and all
costs herein incurred and expended.
IT IS THEREFORE ORDERED, ADJUDGED AND DECREED that the Plaintiff have
judgment against the Defendant, Tony L. Jones, in the principal sum of $54,144.58, plus
continuing interest at the contract rate of 5.6250% from February 13, 2013, as stated in the
