This office was served with a Complaint filed as Case No. 22 CIV 0572. For his
Answer, the Medina County Treasurer states that real property taxes are the first and best
lien on the subject property and that any amounts due for taxes, assessments and penalties
shall be paid before any distribution is made to other lien holders on Permanent Parcel
Numbers 024-04C-20-008 and 024-04C-26-009.
Please be advised that pursuant to Rule 12 of the Rules of Practice of the Court of
Common Pleas of Medina County, Ohio ("Local Court Rules") the Treasurer need not be
served with pleadings in a foreclosure case unless the party filing the pleading intends to
challenge the taxes claimed by the Treasurer on the tax record, either as to amount, validity,
or as to priority as first and best lien. Please contact this office directly, in a timely manner,
should you intend to challenge the taxes in the instant matter.
In accordance with Local Court Rule number 7, upon a dismissal, Judgment Entry
for Foreclosure and/or Distribution of Proceeds of Sale etc., each entry shall be submitted
to this office for approval. Submissions for approval of an entry may be’sent to this office
