PLAINTIFF’S MOTION FOR SHORT ORDER OF NOTICE
Now comes the Plaintiff, Citrus Property Investments, LLC, in the above-entitled matter
and move for approval of a short order of notice for a hearing on the Plaintiff’s Motion for
Approval of Memorandum of Lis Pendens relating to the real estate of the Defendants located at
51 Beaver Street, Worcester, Massachusetts, being the land described in the Deed recorded with
the Norfolk County Registry of Deeds in Book 68044, Page 298.
The Plaintiff states that the subject matter of the action constitutes a claim of a right to title
to real property or the use and occupation thereof or the buildings thereon.
The Plaintiff further states that there is a clear danger that the Defendants will encumber,
transfer, sell, or otherwise alienate the property or the improvements thereon. The Defendants
could convey the property to an innocent third party thereby extinguishing Plaintiff’s security
interest in the property.
Therefore, Plaintiff respectfully requests a short order of notice for hearing on its Motion
for Approval of Memorandum of Lis Pendens.
