MONTGOMERY COUNTY, TEXAS MICHAEL DAVID MERRITT 284â„¢ JUDICIAL DISTRICT DEFAULT JUDGMENT On this day the above entitled and numbered cause, wherein Hochheim Prairie Ins. Subrogee for Steve Gamez, is Plaintiff, and Michael David Merritt , is Defendant was heard by the Court. Plaintiff, Hochheim Prairie Ins. Subrogee for Steve Gamez, appeared through attorney of record, Law Office of O. L. Knutson. Defendant, Michael David Merritt, though duly, legally and regularly cited according to law, failed to appear and wholly made default. The Court finds that every process of law was duly and legally performed and every notice was duly given to Defendant as required by law; Defendant nevertheless made default. Jury was waived and matters of law and things in controversy were submitted to the Court in a due and regular order. The Court finds, upon good and sufficient evidence, that Plaintiff, Hochheim Prairie Ins. Subrogee for Steve Gamez, is entitled to recover from, Defendant, the sum of $ 2,453.83 in property damage expenses arising out of an accident in Conroe, Montgomery County, Texas; IT IS THEREFORE ORDERED, ADJUDGED AND DECREED by the Court that Plaintiff, Hochheim Prairie Ins. Subrogee for Steve Gamez, is entitled to recover from Defendant, Michael David Merritt, (DOB: 08/03/1985 and D/L: TX 2635956), the following: 1 Property Damage Expenses $ 2,453.83 2 Prejudgment Interest at the rate of 5% per annum from] 1/21/2013 $ 34.46 3 Attorney Fees - Pursuant to TIC Section 542.302 $ 500.00 Total $ 2,988.29 IT IS FURTHER Ordered, Adjudged and Decreed that Plaintiff be granted all costs of court and post-judgment interest at 5 % per annum.
