I am one of the attorneys of record in this action for Plaintiff, and I have 18 personal knowledge of the following facts. If called to testify to the same, I could and would be willing to do so. 20 1. This case was filed March 8, 2019. 21 2. Plaintiff experienced extreme difficulty serving Defendant ELINA M BACKALLY LEVY through 22 traditional methods. 23 3. Between March 2019 and Apri12019, Plaintiff attempted to effect service at given address, however, despite numerous service attempts, Plaintiff was unable to effect service. 25 4. Plaintiff filed an Application for Service by Publication, but it was rejected on December 23, 2019. 5. Plaintiff re-filed an Application for Service by Publication, and Court granted it on February 27, 2020. 28 6. Defendant was served by Publication starting on March 23, 2020. 7. Proof of Service by Publication was filed on April 20, 2020. 8. Defendant failed to file a responsive pleading prior to the date of default. 9. Plaintiff submitted a Default Judgment Package and it is currently under review with the Court 10. Please continue the Order to Show Cause for 90 days, or for enough time into the future for the Court to enter Judgment.
