Index No. 507079/2020 Dear Mr. Cassady, As you are aware, this firm represents OPERA HOUSE LOFTS LLC (the “Landlord”), the net lessee of the building located at 27 Arion Place, Brooklyn, New York (the “Building”). Reference is made to the Subpoena Duces Tecum & Ad Testificandum dated July 7, 2022 (the “Subpoena”), which was served upon the Landlord on July 27, 2022 and pursuant to which your clients, Defendant-Tenants, seek disclosure of documents returnable on July 29, 2022 and the deposition of Henry Radusky, A.I.A. on August 4, 2022. Please be advised that the Subpoena is defective in that a copy of same was not simultaneously served upon the Landlord as required by CPLR §3120. Accordingly, the Landlord was deprived of reasonable notice thereof. Moreover, the Subpoena is improper in that it seeks to “obtain documents and testimony which may be relevant to the defenses interposed by Defendants-Tenants in this action in which Defendants-Tenants allege, inter alia, that no valid and enforceable certificate of occupancy exists for the Building (defined above)”. NO. 328 RECEIVED NYSCEF: 07/29/2022 Pursuant to the Order & Declaratory Judgment of the Supreme Court (Silber, J.) dated November 3, 2021, the Court held that the Building had a valid and enforceable residential certificate of occupancy since February 22, 2005 (the “2005 C of O”). The 2005 C of O has been and remains in effect through present. Defendants-Tenants are not entitled to any discovery relating to the 2005 C of O given the Order & Declaratory Judgment, because the issue has been fully adjudicated and final as against Defendants- Tenants. Accordingly, based on the foregoing, the Subpoena is frivolous within the meaning of 22 NYCRR §130-1.1 because it is (i) completely without merit in law and cannot be supported by a reasonable argument for an extension, modification or reversal of existing law; and (ii) undertaken primarily to delay or prolong the resolution of this litigation, and to harass or maliciously injure the Landlord. Unless Defendants-Tenants withdraw the Subpoena by 5:00 pm today, July 28, 2022, the Landlord will take appropriate action, including moving to quash the Subpoena and for sanctions and costs incurred as a result of the above-described sanctionable and frivolous conduct.
