I, CRISTIN GARDEN, hereby declare and state as follows:

1. I am the Credit Manager in charge of the Credit Department of Plaintiff herein and am
21
authorized to undertake this Declaration for and on behalf of Plaintiff herein.
22
2. My duties include concurrent supervision and control over the employees of and the
23
bookkeeping procedures in Plaintiffs Receivables, Credit, Collection or Accounting Department.
24
I am familiar with the jobs of the employees I supervise and the methods they use in making
25
bookkeeping entries and maintaining Plaintiffs books and records, which are made in the regular
26
course of business and are made at or near the time of the occurrence of the transactions which
27

they record. I can, if required, as one of the custodians of Plaintiffs books and records, testifY to
2 their identity and mode of preparation.
3 3. If called to testify herein, Declarant has personal and first hand knowledge of the mode
4 of preparation of all of the books, records, papers and files which constitute the running account
5 herein of Defendants in favor of Plaintiff herein.
6 4. These books, records, papers and files primarily consist of accounts receivable ledgers,
7 books and journals, statements, invoices, delivery tags, papers, files, credit memorandum and other
8 related materials thereon and along with other materials which are normally used in the operation
9 of the Plaintiffs business for the purpose of maintaining receivable information herein. Some or
10 all of these materials are contained in computers and related electronic word processing equipment
11 which serve as substitute for traditional account receivable journals, books and records. These
12 books and records indicate and show that Plaintiff sold and delivered, furnished and rendered or
13 supplied directly or indirectly or primarily goods/wares/merchandise and each of the same, at an
14 open book account on the dates and in the amounts set forth in the statement which is attached
15 hereto marked EXHIBIT '"A" and EXHIBIT ''B'' and incorporated by reference. Said statement
16 marked EXHIBIT "'A" and EXHIBIT "B" contains a running and current list of all of the
17 invoices and or charges, and each of the same, which are presently due, setting forth the date of the
18 invoice and/or charge, the due date thereof, the invoice and/or charge number and the amount
19 thereof, indicating a present unpaid balance in the amount of$312,496.21. The attached statement
20 shows all payments, if any there be, made on account of the invoices set forth therein, and all
21 accrued and accruing service charges, if any there be. EXHIBIT "'A" and EXHIBIT "B" is a
22 true and authentic copy ofPlaintiffsjournal page, ledger card and computer print-out or otherwise
23 itemized statement indicating all charges and payments applied to those invoices and/or charges,
24 and each of the same. The records constituting EXHIBIT "'A" and EXHIBIT "B" which are
25 attached hereto, constitute a true, correct and authentic copy of the original record which
26 otherwise could be made available at the hearing herein. EXHIBIT "'A" a11d EXHIBIT "B"
27 was initiated, produced, maintained and completed under the concurrent supervision and control of

I the Declarant, among others, and is a true and correct statement of the account by and between
2 Plaintiff and Defendants.
3 5. There is now due, owing and unpaid on said accounts owed by said Defendants, and
4 each of them, the sums, amounts and charges listed on Exltibit "A," which is attached hereto and
5 incorporated by reference as though fully set forth herein.
6 6. The original and duplicate originals of EXHIBIT "'A" and EXHIBIT "B" and the
7 originals of the invoices as listed in EXHIBIT"~" and EXHIBIT "B" have all been forwarded
8 to the Defendants at their place of business as stated on Exltibit ~~,"postage prepaid, by first
9 class mail, at or near the time of the date of EXHIBIT~~~" and EXHIBIT "B"
10 7. The statement and invoices, if any, as attached and marked herein, were made in the
11 regular course and scope of the business of the Plaintiff herein as purveyor, vendor or provider or
12 otherwise doing business as Supplier/Distributor; the writings and entries thereon or memoranda
13 therein, or entries in and to any system thereon, or records or posts the information as necessary,
14 were made at or near the time and date of the charges set forth on the statement and invoices, if
15 any. Said charges, and each of them, as reflected by the statements and the invoices, and each of
16 them, were made in the regular course of business herein by the Plaintiff in the maintenance of its
17 records for the sale or rendition of the goods or services as set forth above. The underlying
18 requests for the purchases or acquisition of the goods/services were initiated by the Defendants, or
19 one of them, on their behalf herein, and communicated to an appropriate order taker, such as a
20 sales representative, order taker, telephone clerk, or others as the case may be or otherwise
21 authorized by way of contract herein, which said order became promptly memorialized by way of
22 the entry in and to the accounts receivable, accounting, sale or credit department, which ultimately
23 generated the invoices and/or statement herein.
24 8. At all times herein mentioned, Plaintiff is a corporation, as shown in the caption hereof,
25 doing business in the State of California, which has granted, issued or otherwise provided Plaintiff
26 with all of the necessary licenses, certificates and permits for Plaintiff to sell, deliver, vend, furnish
27 or supply the goods or services to Defendants, and each of them, if any need be so necessary to

1 undertake the subject transactions, and each of them.
2 9. The books, records, and papers ofPiaintiff indicate that, at all times herein mentioned,
3 Defendants, and each of them, have been or presently are engaged in the trade or business and
4 under the trade name or trade style of PIZZERIA VBNTJ, VOYA RESTAURANT and CUCJNA

6 10. Plaintiff is entitled to interest, service charges or finance charges, as the case may be,
7 at the rate of 10% per annum fiom and after December 10, 2020 until either judgment is taken
8 herein or until paid in full, on the declining unpaid balance hereof as the Defendants have agreed
9 to such interest, service and finance charges, and each of them, all pursuant to the provisions of
10 Exhibits ·~"which are attached hereto and incorporated by reference as though set forth herein.
II 11. Declarant is employed by the Plaintiff whose address is 580 Monterey Road, OUray
12 (County of Santa Clara), California 95020 and place of employ and therefore, if needed, would
13 appear by way of conference call (or like) or ZOOM, if the court so allows ..

I am the Credit Manager in charge of the Credit Department of Plaintiff herein and am 21 authorized to undertake this Declaration for and on behalf of Plaintiff herein. 22 2. My duties include concurrent supervision and control over the employees of and the 23 bookkeeping procedures in Plaintiffs Receivables, Credit, Collection or Accounting Department. 24 I am familiar with the jobs of the employees I supervise and the methods they use in making 25 bookkeeping entries and maintaining Plaintiffs books and records, which are made in the regular 26 course of business and are made at or near the time of the occurrence of the transactions which 27 28 1 DECLARATION IN SUPPORT OF ISSUANCE APPLICATION FOR ISSUANCE OF WRIT OF ATTACHMENT. AFTER · HEARING UNDER C.C.P. SECTION 484.090 ETC. they record. I can, if required, as one of the custodians of Plaintiffs books and records, testifY to 2 their identity and mode of preparation. 3 3. If called to testify herein, Declarant has personal and first hand knowledge of the mode 4 of preparation of all of the books, records, papers and files which constitute the running account 5 herein of Defendants in favor of Plaintiff herein. 6 4. These books, records, papers and files primarily consist of accounts receivable ledgers, 7 books and journals, statements, invoices, delivery tags, papers, files, credit memorandum and other 8 related materials thereon and along with other materials which are normally used in the operation 9 of the Plaintiffs business for the purpose of maintaining receivable information herein. Some or 10 all of these materials are contained in computers and related electronic word processing equipment 11 which serve as substitute for traditional account receivable journals, books and records. These 12 books and records indicate and show that Plaintiff sold and delivered, furnished and rendered or 13 supplied directly or indirectly or primarily goods/wares/merchandise and each of the same, at an 14 open book account on the dates and in the amounts set forth in the statement which is attached 15 hereto marked EXHIBIT '"A" and EXHIBIT ''B'' and incorporated by reference. Said statement 16 marked EXHIBIT "'A" and EXHIBIT "B" contains a running and current list of all of the 17 invoices and or charges, and each of the same, which are presently due, setting forth the date of the 18 invoice and/or charge, the due date thereof, the invoice and/or charge number and the amount 19 thereof, indicating a present unpaid balance in the amount of$312,496.21. The attached statement 20 shows all payments, if any there be, made on account of the invoices set forth therein, and all 21 accrued and accruing service charges, if any there be. EXHIBIT "'A" and EXHIBIT "B" is a 22 true and authentic copy ofPlaintiffsjournal page, ledger card and computer print-out or otherwise 23 itemized statement indicating all charges and payments applied to those invoices and/or charges, 24 and each of the same. There is now due, owing and unpaid on said accounts owed by said Defendants, and 4 each of them, the sums, amounts and charges listed on Exltibit "A," which is attached hereto and 5 incorporated by reference as though fully set forth herein. 6 6. The original and duplicate originals of EXHIBIT "'A" and EXHIBIT "B" and the 7 originals of the invoices as listed in EXHIBIT"~" and EXHIBIT "B" have all been forwarded 8 to the Defendants at their place of business as stated on Exltibit ~~,"postage prepaid, by first 9 class mail, at or near the time of the date of EXHIBIT~~~" and EXHIBIT "B" 10 7. The statement and invoices, if any, as attached and marked herein, were made in the 11 regular course and scope of the business of the Plaintiff herein as purveyor, vendor or provider or 12 otherwise doing business as Supplier/Distributor; the writings and entries thereon or memoranda 13 therein, or entries in and to any system thereon, or records or posts the information as necessary, 14 were made at or near the time and date of the charges set forth on the statement and invoices, if 15 any. Said charges, and each of them, as reflected by the statements and the invoices, and each of 16 them, were made in the regular course of business herein by the Plaintiff in the maintenance of its 17 records for the sale or rendition of the goods or services as set forth above. The underlying 18 requests for the purchases or acquisition of the goods/services were initiated by the Defendants, or 19 one of them, on their behalf herein, and communicated to an appropriate order taker, such as a 20 sales representative, order taker, telephone clerk, or others as the case may be or otherwise 21 authorized by way of contract herein, which said order became promptly memorialized by way of 22 the entry in and to the accounts receivable, accounting, sale or credit department, which ultimately 23 generated the invoices and/or statement herein. 24 8.
