On January 26, 2022 Defendant filed an Application to Prevent Forfeiture Due to
COVID-19 Rental Debt per CCP 1179.13. While paragraph 3(a) is checked on form UD-125,
the application does not comply with the requirements set forth in CCP 1179.13(B)().
Specifically, no copy of a final decision from the government rental assistance program
showing the property address, the amount of payment approved, and the time period for which
assistance was provided. Document attached reflects application status as “application under
review,” contains no time period for which assistance was provided and no amount approved.
Therefore, based on the non-complaint application filed with the Court, no relief under
CCP 1179.13(d)(2) is available and the execution of the writ of possession issued in this case|is
not stayed. The Clerk of the Court shall notify the Sheriff accordingly.
IT IS SO ORDERED.
