DECLARATION OF NANCY Y. LEWELLEN
2 I, Nancy Y. Lewellen, declare as follows:
3 1. I am a co-trustee of the Nestel Revocable Trust, established February 21, 1997
4 "(Nestel Trust"). The facts contained herein are true based on my personal knowledge and if called
5 upon as a witness in the case, I could and would testify competently to the truth thereof.
6 2. I am a California licensed attorney and am currently employed by the Palladian Law
7 Group where I practice business, real estate, and trust and estate law. My business address is 605
8 Market Street, Suite 505, San Francisco, C 94105. Prior to becoming an attorney, I received an
9 MBA in Finance from U.C. Berkeley, and was Vice President at Crocker Bank, N.A., and held
10 management positions at Bank of America, NTSA, and First Nationwide Bank for more than 19
11 years. As a result, I am very familiar with the handling of trust assets, as well as the many types of
12 accounts that Mrs. Nestel has placed into the Nestel Trust, and would be fully capable to handle the
13 finances of the Trust.
14 3. On or about July 1, 2019, I was appointed as co-trustee of the Nestel Trust. A true
15 and correct copy of the "Certificate of Trust Existence and Authority," which is fully executed and
16 notarized, is attached to this declaration as Exhibit A. I estimate that value of the assets held by the
17 Nestel Trust is currently approximately $5 million.
18 4. On or about July 1, 2019, I was appointed as Power of Attorney forHarryette Nestel.
19 Pursuant to the Power of Attorney granted to me by Mrs. Nestel, I am authorized to transfer and
20 convey any or all assets held in the name ofHarryette Nestel and/or the Nestel Trust, including real
21 estate, ownership rights in insurance policies, cash, checks, stocks, bonds, securities and/or any
22 other property. I am authorized to make deposits and withdrawals from any banking accounts held
23 in the name ofHarryette Nestel and/or the Nestel Trust, and am authorized to sell or buy securities
24 in any investment account held in the name ofHarryette Nestel and/or the Nestel Trust. I am also
25 empowered to sign checks and pay bills ofHarryette Nestel. A true and correct of the fully
26 executed and notarized Power of Attorney, dated July 1, 2019, is attached to this declaration as
27 Exhibit B.

5. As co-trustee of the Nestel Trust for the last three months, I am well aware of the
2 financial turmoil that was caused by the former trustee of the Nestel Trust, Neil Fisher's, decision to
3 take an erroneous incapacity letter to Wells Fargo Bank and Ameritrade in an effort to prohibit Mrs.
4 Nestel from accessing any money in her own financial accounts. On numerous occasions over the
5 last three months, as co-trustee of the Nestel Trust, I have personally visited branches of Wells
6 Fargo and Ameritrade, and tried to withdraw money for the benefit of Mrs. Nestel from her
7 accounts. In each instance, I was told that even as a co-trustee of the Nestel Trust and with an
8 express Power of Attorney, the accounts were frozen by their legal departments and no funds could
9 be withdrawn from these accounts without a court order. This has caused great distress to Mrs.
10 Nestel.
11 6. Wells Fargo and Ameritrade have frozen Mrs. Nestel's accounts, and denied Mrs.

16 interim order to be granted so that I, as co-trustee of the Nestel Trust, can withdraw the necessary
17 funds from her accounts to pay her outstanding expenses. Without access to any funds, Mrs.
18 Nestel's credit card companies could suspend her credit and deny further charges. As Mrs. Nestel is
19 94 years old, she could be in dire jeopardy without food and caregiving.
20 7. Mrs. Nestel has incurred significant expenses that she has been unable to pay.
21 Specifically, she has an American Express credit card bill with a past due balance of$7,163.51. She
22 also has a Chase credit card bill of$11,792.54, a Wells Fargo credit card bill of$462.74 and a
23 Costco Visa card bill of $2,903.32. If she does not pay these credit card bills, her credit card
24 companies could decline her credit. Moreover, she has a past due balance to AT&T of$788.55, a
25 past due balance due of$313.82 to San Francisco Water and Sewer and a past due balance to PG&E
26 of$1,108.49. If these utility bills are not paid, she is in jeopardy of losing her telephone service,
27 water, gas and electricity. She also owes $886.44 for the first installment for her property taxes for
28 her home. As for health care, she owes $125.57 to UCSF Health, $1,196.07 to Anthem Blue Cross

and $177.00 to her dentist. Most importantly, she has significant caregiving bills that have gone
2 unpaid. Her son, Willian, has advanced Parkinson's disease and needs care, so Mrs. Nestel has been
3 paying for his caregivers, Specifically, Mrs. Nestel currently owes $32,200 in past due bills for
4 William's caretakers from July 4, 2019 to October 4, 2019. She also owes $45,000 in past due
5 caretakers bills for herself for the period of July 4, 2019 to October 11, 2019.
6 8. In total, Mrs. Nestel has $104,118.05 in past due expenses and we ask this Court to
7 issue an interim order allowing her banks�to authorize withdrawals so that I can withdraw these
8 funds and pay Mrs. Nestel's outstanding expenses. All of these past due expenses are detailed in
9 Exhibit C to this declaration.
10 9. If this interim request is not granted, Mrs. Nestel will eventually have no credit to
11 pay for living and caregiving expenses. She is 94 years old and has no other source of income, so
12 this is a serious issue.

The undersigned, Harryette F3. Nestel, a single woman, is the Settloz~ and Harryette
B. Nestel and Nancy Lewellen are the Co-Trustees of the ~-Iarryette B. Nestel Trust Dated
July 1, 2019. Upon the death, resignation, inability or refusal of~either original Trustee to
serve, then the si2i;ivor of them shall serve as Trustee alone.
