NOW, on this the 27th day of August, 2007, t
on for hearing pursuant to an Order of this Court #sSued on August
2, 2007; and, it appearing to the Court “tha he necessity of
filing and presenting to the Court a final accounting has been
waived by Order of the Court and filed herein; and, it further
appearing to the Court on satisfactory proof and evidence that the
necessary expenses of funeral, of last illness, and of
administration of said estate have been fully administered,
pursuant to due notice given and served, reference being had
thereto, and that said estate is ready for distribution.
It further appearing to the Court that due notice of the
application for this Decree assigning the estate to the persons
entitled thereto by law and in accordance with the laws of the
State of Oklahoma has likewise been duly given and served pursuant
to law in such case made and now provided.
The Court conducted a judicial inquiry into the sufficiency of
the Notice to Creditors and finds that the Notice to Creditors, as
required by the provisions of 58 0.8. Supp. $$243 and 331, and as
of the date said Notice to Creditors was filed with the District
Court Clerk of Oklahoma County, at their respective last known
addresses, and that all claims not filed with the time permitted
for the presentation of claims are non-suited, void and forever
barred. The Court further finds that claims were filed herein by
Norma Lee Summers and Ray David Summers, Sr., and that said
claimants have filed withdrawals of their respective claims.
The Court further finds that the estate is insufficient in
size for payment of Federal Estate Tax, and that an Oklahoma Order
Exempting Estate from Payment of Estate and Inheritance Taxes is
attached hereto and made a part hereof, that all income taxes due
from decedent prior to his death have been paid, and that all
federal and state income taxes due from said estate have been paid.The Court further finds that the decedent, Ray David Summers,
Jr., left as his sole heirs at law the following, to-wit:

The Court further finds that the assets of the estate consists
of the following:
Personal Property:

Real Property:
Lots 25 and 26, Block 46, Industrial Addition,

according to the recorded plat thereof

The Court finds that the Personal Representative, Ray David
Summers, Sr., has waived his right to a statutory fee; and, that
the Personal Representative has approved an attorney fee to be paid
to Ed Carrier and Patrick E. Moore in the sum of $3,250.00 and un-
reimbursed court costs advanced in the sum of $24.47 which the
Court finds to be reasonable and which is hereby approved.
The Court further finds that pursuant to the provisions of the
Statutes of the State of Oklahoma, the estate of Ray David Summers,
Jr. should be distributed as follows:
Ray David Summers, Sr. - one-half of the estate
Norma Lee Summers - one-half of the estate
IT IS THEREFORE ORDERED, ADJUDGED AND DECREED by the Court
that the Personal Representative shall pay the sum of $3,250.00 to
Ed Carrier and Patrick E. Moore for attorney fees and un-reimbursed
court costs advanced in the sum of $24.47; and,
TT IS FURTHER ORDERED, ADJUDGED AND DECREED by the Court that
the estate of Ray David Summers, JUr., consisting of the above
described personal and real property, as well as any other assets
of said estate that are not now known, but that may later be
discovered, be and the same are hereby distributed as follows:Ray David Summers, Sr. - one-half of the estate
Norma Lee Summers - one-half of the estate

ORDER EXEMPTING ESTATE FROM PAYMENTS OF ESTATE
AND INHERITANCE TAXES
THE OKLAHOMA TAX COMMISSION, having examined the information filed with it and
considered all the facts and law in the matter, and being well and sufficiently advised in the
premises, FINDS, that the return is acceptable as filed.
IT IS THEREFORE ORDERED that said estate and the (Legal Representative), are exempt
from payment of any estate tax by reason of the fact that the net value of the estate as reported to
the Oklahoma Tax Commission is exceeded by the exemptions allowed by statute, and all
property, real or personal, tangible or intangible, transferred in said estate is released from any
ESTATE TAX LIEN.
