Webb, Personal Representative of the Estate of Keith Wing Webb, Deceased, and the Petition for Order Allowing Final Report and Determining Heirship and Petition for Final Decree of Distribution and Discharge filed herein by the Personal Representative, and pursuant to an Order of this Court entered herein on the 17th day of September, 2008; and this Court having examined the Final Report, Petition for Order Allowing Final Report and Determining Heirship and Petition for Final Decree of Distribution and Discharge; and the Personal Representative being present personally and being represented by the attorney of record, Carolie E. Rozell; and the Court having heard the evidence and being fully advised in the premises; and there being no objection, FINDS: L The date of this hearing has been fixed and due notice thereof given as required by law and by the Order of this Court, all of which appears more fully from the affidavits of publication and mailing on file herein, On this day this Court has full jurisdiction to hear the Final Report, Petition for Order Allowing Final Report and Determining Heirship and Petition for Final Decree of Distribution and Discharge. I. This Court conducted a judicial inquiry and determined that the Personal Representative made diligent efforts to determine the identities, last-known addresses, and claims of the decedent's creditors and gave Notice to Creditors, all as required by law. This Court specifically determined that the Notice to Creditors as required by Title 58, Oklahoma Statutes, §§243, 331-331.2, and 632.3 was given by the Personal Representative, including notice by mail to all creditors, if any, known to the Personal Representative as of the June 3, 2008, the date said Notice to Creditors was filed with the District Court Clerk for Oklahoma County, the County in which this probate is pending, at their respective last-known addresses, as evidenced by the Personal Representative's Affidavit of non- mailing of said Notice to Creditors of the decedent pursuant to Title 58, Oklahoma Statutes, §332, and including notice by publication, as evidenced by the Affidavit of the Publisher of the Journal Record indicating the publication of said Notice to Creditors on June 4, 2008, and June 11, 2008, both of which Affidavits were heretofore filed in this cause. All claims not filed within the time permitted for the presentation of claims, being on or before the presentment date of August 7, 2008, Order Allowing Final Report Page 1set forth in said Notice to Creditors, are non-suited, void and forever barred, except as otherwise provided in Title 58 of the Oklahoma Statutes, or any claim for which payment has been heretofore approved or is hereinafter approved in this Decree pursuant to Title 58, Oklahoma Statutes, §335. This Court specifically finds that there have not been any claims presented to the Personal Representative against the Estate of the decedent. All expenses of the funeral and last illness of the decedent have been paid. I. All changes in assets as reported in the Final Report should be approved and allowed. Iv. Attached hereto, marked Schedule "A", and by specific reference made a part hereof, is atrue and correct statement of all assets ready for distribution. Vv. All lawful debts of the Estate have been paid. All expenses of the administration of the Estate have been paid in full as of the date hereof, except for miscellaneous filing fees, court costs and expenses incident to the distribution and closing of the Estate. VE. A fee of $2,500.00 should be allowed to Fulkerson & Fulkerson, P.C., for legal services rendered the Personal Representative, and the sum of $425.00 should be allowed as reimbursement for costs advanced. Vil. The Personal Representative has waived her statutory commission allowed for services rendered the Estate. VHL The Personal Representative should be authorized and directed to pay all miscellaneous filing fees, court costs and expenses incident to the distribution and closing of the Estate. IX. ‘The Personal Representative timely filed the required Oklahoma Estate Tax Return. No estate taxes were due and payable, and the Oklahoma Tax Commission clearance is on file herein, a copy of the same being attached hereto as Schedule "C". No Federal Estate Tax Return was required and no federal taxes were due. All income taxes due and owing the State of Oklahoma and Order Allowing Final Report Page 2the United States of America by the decedent and the Estate have been paid in full. There are no ad valorem or other taxes due and unpaid. All state, county and municipal taxes legally levied upon personal property in the Estate and of the decedent have been paid in full. X. The decedent was survived by the following heir-at-law, and no others, to-wit: Name/Address Age Relationship Erma J. Webb legal mother 1225 S. W. 50th Oklahoma City, Oklahoma 73119 The decedent left surviving no children and no issue of any deceased child or children. No possibility of any pretermitted issue exists. XI. The decedent died intestate in the City of Oklahoma City, State of Oklahoma, on or about the the 26th day of November, 2006, a resident of Oklahoma County, State of Oklahoma, at the time of death. XII. The rest, residue and remainder of the Estate, wheresoever situated and whether inventoried or not, including any later discovered assets, should be distributed, assigned, transferred, set over and conveyed as set forth in Schedule "B" attached hereto and by specific reference made a part hereof, pursuant to the intestate laws of the State of Oklahoma. IT IS THEREFORE ORDERED, ADJUDGED AND DECREED BY THE COURT as follows: 1 The Final Report of the Personal Representative of the Estate of Keith Wing Webb, Deceased, are approved, allowed and confirmed in all respects. 2. The decedent is determined to have died intestate in the City of Oklahoma City, State of Oklahoma, on or about the the 26th day of November, 2006, a resident of Oklahoma County, State of Oklahoma, at the time of death. W. 50th Oklahoma City, Oklahoma 73119 The decedent left surviving no other child or children and no other issue of any deceased child or children. No possibility of pretermitted issue exists. 4, A fee of $2,500.00 is allowed to Fulkerson & Fulkerson, P.C., for legal services tendered the Personal Representative and the Estate, and the sum of $425.00 is allowed as reimbursement for costs advanced. 5. The Personal Representative has waived her statutory commission allowed for services rendered the Estate. 6. The Personal Representative is authorized and directed to pay all miscellaneous filing fees, court costs, and expenses incident to the distribution and closing of the Estate. 7. The Personal Representative is determined to have timely filed the required Oklahoma Estate Tax Return, no taxes having been due thereon and clearance is on file herein; no Federal Estate Tax Return was required and no federal taxes were due; to have paid all income taxes due and owing to the State of Oklahoma and the United States of America by the decedent and the Estate; to have paid all ad valorem or other taxes due and owing; and to have paid all state, county, school, and municipal taxes legally levied upon personal property in the Estate and of said decedent. 8. The rest, residue, and remainder of the Estate, wheresoever situated and whether inventoried or not, including any later discovered assets, is distributed, assigned, transferred, set over, and conveyed as set forth in Schedule "B" attached hereto and by specific reference made a part hereof, pursuant to the intestate laws of the State of Oklahoma. 9.
