PETITIONER’S REQUEST FOR MINOR CHILD TO BE PERMITTED TO
EXPRESS PREFERENCE ON CUSTODY AND VISITATION
SSS CTE MINUS TORY AND VISITATION
COMES now, the Petitioner herein, BRAD J. KASTL, by and through his
attorney of record, Jill M. Ochs-Tontz, of Ochs-Tontz Law, P.L.L.C., and hereby
moves this Honorable Court to allow the minor child, Madison Lee Kastl, born
March 10", 2006, now 13 years old but soon to be 14. years old, to express her
preference as to custody and visitation, in keeping with Okla. Stat. Tit. 43 0.S.
§113. Petitioner would request the court hold an in camera hearing and would
request a court reporter during these proceedings and would ask the court to
make a finding that it is in the best interest of the child to express a preference as
to custody and visitation. That visitation is at issue with this child and the
Petitioner believes the child has a strong preference on visitation and custody
and hereby requests she be allowed to state that to the court.
WHEREFORE, that for good cause shown, as stated herein above, that
this minor child be allowed to express their preference regarding custody to the
Judge, at a date to be determined by this court, as the minor child has a strong
feeling towards a preference in visitation and custody and is able to make an
intelligible preference.
