Esq., dated October 11, 2019, the exhibits annexed thereto, and upon all prior pleadings and
proceedings heretofore had herein, the undersigned will move this Court at the Supreme Court of
the State of New York, County of Dutchess, located at 10 Market Street, Poughkeepsie, New

York on the day of November, 2019 at 9:30 o'clock in the forenoon of that day or as soon
thereafter as counsel can be heard for an Order: 1.) Pursuant to CPLR §2304 quashing the
subpoena for the nonparty deposition of Dr. Thomas M. Griffiths; 2.) Pursuant to CPLR §3103,
for a protective order precluding the deposition of Dr. Thomas M. Griffiths; 3.) In the
alternative, pursuant to §3103, for a protective order limiting the scope of the examination to Dr.
Griffiths'
Thomas M. IME report and that he not be compelled to answer expert opinion
questions; and 4) For such other and further relief as this Court may deem just and proper.
