WHEREAS, this is an action for, inter alia, a declaratory judgment (the first
cause of action) that the Certificate of Occupancy No. 301247327 issued on February 22,
2005 by the New York City Department of Buildings (the “2005 C of O”) is valid and is
applicable to the building located at 11-27 Arion Place, Brooklyn, New York (the
“Building”) on Lot 40, and that the NYC Department of Buildings erroneously stated
thereon that the 2005 C of O was issued for Lot 48, which is a vacant lot next to the
building and is also owned by the plaintiff owner, and that as such, the Building
has had a valid residential certificate of occupancy since the issuance of same; and
WHEREAS, Plaintiff commenced this action on March 22, 2020, by the filing of
a Summons & Complaint against Defendants CHRISTOPHER CARNAHAN,
STEPHEN MEYERS, JULIE COVELLO, RYAN SHOLLENBERGER, ALEXANDER

residential tenants of the Building; and
WHEREAS, Plaintiff served and filed an amended complaint on October 23,
2020 (the “Amended Complaint”); and
WHEREAS, Plaintiff served and filed a second amended complaint on February
23, 2021 (the “Second Amended Complaint”); and
WHEREAS, On July 23, 2021, the Court directed Plaintiff to serve and file a Third
Amended Complaint to add the New York City Department of Buildings (“DOB”) as a
party-defendant; and
WHEREAS, DOB having appeared and moved to dismiss the Third Amended
Complaint, in Motion Sequence 4, pursuant to CPLR §3211(a)(7) as there is no justiciable
controversy between the Plaintiff and DOB. DOB acknowledged that there was a
typographical error of the house number and lot number on the 2005 C of O, and

DOB agrees with Plaintiff that the 2005 C of O was issued for the building located at 11-
27 Arion Place Brooklyn, New York on Lot 40 on February 22, 2005, and not for 9 Arion
Place, Brooklyn, NY on Lot 48. DOB stated that it thought that it had corrected the error
by issuing Certificate of Occupancy No. 322033624 on September 21, 2020, pursuant to
its belief that the 2005 C of O already applies to the Building at 11-27 Arion Place, based
on its records, including the final survey submitted in support of the issuance of the 2005
C of O and the metes and bounds description listed thereon. However, DOB argues that
if the Court believes that the 2005 C of O should be amended/corrected, DOB requested
that the Court order it to amend the 2005 C of O, as the NYC DOB is not authorized to
make such a change without a Court order; and
WHEREAS, due deliberation having been had, it is hereby:
ORDERED, ADJUDGED AND DECLARED that Plaintiffs first cause of
action for a declaratory judgment thatthe2005 C of O issued on February 22, 2005 is
valid and applicable to the building located at 11-27 Arion Place, Brooklyn, New York on
Block 3136, Lot 40, and that as such, the Building had a valid residential certificate of
occupancy since the issuance of same, is granted; and it is further
ORDERED, ADJUDGED and DECLARED that the 2005 C of O is valid and
applicable to the Building since its issuance on February 22, 2005; and it is further
ORDERED, ADJUDGED and DECLARED that the Building therefore had a
valid residential certificate of occupancy since February 22, 2005; and it is further
ORDERED that DOB shall amend/correctthe 2005 C of O within thirty (30)
days of service of this Order with Notice of Entry, to reflect the correct house and lot
number for the Building as “11-27 Arion Place, Brooklyn, New York” located on Block
3136 “Lot 40” nunc pro tunc to February 22, 2005, as follows:

DOB shall modify the 2005 C of O to delete Lot Number "48" and insert Lot Number "40"
and to delete the address "9 Arion Place" and insert "11-27 Arion Place," and it is further
ORDERED that defendant DOB shall revoke the Certificate of Occupancy identified
as C of O Number 3222033624F, dated September 22, 2020; and it is further
ORDERED that upon the modification of the 2005 C of O, the Third Amended
Complaint shall be deemed dismissed as against the NYC DOB; and it is further
ORDERED that Plaintiff's remaining causes of action are severed and shall continue.
The foregoing constitutes the decision, order, and judgment of the court.
