ORDER GRANTING PLAINTIFF’S FIRST AMENDED TRADITIONAL
MOTION FOR PARTIAL SUMMARY JUDGMENT
On April 28, 2022, the Court heard the First Amended Traditional Motion for Partial
Summary Judgment (“Motion”) filed by Plaintiff 2021 Meacham and 35W, LLC as assignee of
Tarrant Tierra Partners, Ltd. (“Plaintiff”), inclusive of evidence attached to Plaintiff’s March 25,
2022 Motion for Leave to Supplement the Summary Judgment Record (Exhibit 36) for Purposes
of Refuting Sham Affidavit (“Motion for Leave”). After considering the Motion, evidence,
arguments of counsel for all parties, and applicable law, the Court GRANTS the Motion.
IT IS, THEREFORE, ORDERED, ADJUDGED AND DECREED as follows:
1. Although Plaintiff’s Motion for Leave may have been mooted because the Motion
at that time was scheduled for the afternoon of March 25, 2022 and then subsequently rescheduled
and properly noticed for April 28, 2022 (providing more than 21 days’ notice under Rule 166a(c)),
the Motion for Leave is hereby GRANTED to the extent necessary and, in any event, Exhibit 36
was considered by the Court in weighing the evidence;

2. Plaintiff’s Motion is GRANTED;
3. Plaintiff’s request for an award of reasonable attorney’s fees and costs against

agreeable to Plaintiff and Defendants) to be set on the Court’s docket at ______ a.m./p.m. on
______________, 2022; and
4. Subsequent to the hearing on attorneys’ fees and costs, Plaintiff will submit a
proposed partial or final judgment related to this Order and any additional relief to which Plaintiff
is entitled.
