The May 16, 2017 Decisions entered by the Florida 5th DCA, “Per Curiam. Affirmed” as to the final judgments entered in favor of Appellees, Good Gateway, LLC and SEG Gateway, LLC against Appellants Chittranjan K. Thakkar, Niloy and Rohan, LLC, and NCT Systems, Inc.(collectively “Thakkar”); and Emerson Noble, Chapter 7 Trustee for Orlando Gateway Partners, LLC and Nilhan Hospitality, LLC (Ex. A, Case No. 5D14-3962 and Case No. 5D14-3964). These decisions are highly relevant to several fully briefed motions pending before this Court (i.e. motions to compel and related to discovery in aid of execution, motions to enjoin Thakkar from making transfers, motion to inspect property, etc.). Section 90.202(6), Florida Statutes, provides that a court may take judicial notice of “records of any court of this state or of any court of record of the United States or of any state, territory, or jurisdiction of the United States.” The majority of the district courts which have addressed the issue have recognized the propriety of taking judicial notice of otherwise appropriate -2- documents. See e.g., City of Miami v. F.O.P. Miami Lodge, 571 So. 2d 1309, 1333, n. 10 (Fla. 3d DCA 1989) (taking judicial notice of a city resolution); Lagarde v. Outdoor Resorts of Am., 428 So. 2d 669,670 (Fla. 2d DCA 1982) (taking judicial notice of records of a prior appeal); Ashman v. State, 886 So. 2d 1079, 1081 (Fla. 5th DCA 2004)(taking judicial notice of Polk County court documents so as to determine whether Orange County prosecution was barred by double jeopardy); Weeks v. Florida Birth Related Neurological, 977 So. 2d 616, 622 (Fla. 5th DCA 2008)(Sawaya, J. specially concurring). Contra Hillsborough Cnty. Bd. v. Public Emps.
