SUMMARY JUDGMENT
Pending before the Court is Petitioner’s motion to enforce a Rule 11 agreement
that Petitioner and Respondent had agreed to execute the Agreement Incident To Divorce
filed as a Rule 11 agreement on October 5, 2015 (“AID”). Based upon the summary
judgment evidence, the Court concludes as a matter of law that Petitioner and Respondent
agreed to the terms of the AID and that the AID is a legally enforceable contract.

SUMMARY JUDGMENT
Pending before the Court are Petitioner’s Alternative Motions For Partial
Summary Judgment filed October 22, 2015. Based upon the summary judgment
evidence, the Court grants the motions in all respects. Accordingly, it is hereby declared
that before either parent can seek or consent to (a) medical, dental and surgical treatment
involving an invasive procedure or (b) in-patient or out-patient psychiatric and
psychological evaluation or treatment, the parent must obtain the prior agreement of the
other parent. It is further declared that Respondent Robert L. Wolfle, Jr. must pay for and
maintain health insurance, dental insurance, orthodontic insurance and counseling
insurance for each of the parties’ three children as provided for in paragraph D(1) of the
AID filed October 5, 2014.
