describedintheSupplementalAffidavitattachedhereto(collectively,"OriginalCreditor"),andIhavepersonal
knowledgeof
andaccesstoOriginalCreditor'sbooksandrecords("BusinessRecords"),includingelectronicrecords,relatingtoapoolof
charged-offconsumercreditaccountssoldorassignedbyOriginalCreditortoShermanOriginatorHILLC("DebtBuyer"),
on12/17/2019(the"Sale"),whichincludedtheaccount("Account")oftheconsumer("Consumer")asidentifiedinthe
exhibitsattachedheretoandincorporatedberein.AspartoftheSale,OriginalCreditorassignedallofitsinterestinthe
Accounts,includingtherighttoanyproceedsfromtheAccounts,toDebtBuyer,andittransferredBusinessRecords
relatingtotheAccountstoDebtBuyer.AtrueandcorrectcopyofthebillofsaleorwrittenassignmentoftheAccountis
attachedasanexhibittothisaffidavit.
2. Inmyposition,IalsohavepersonalknowledgeofOriginalCreditor'sproceduresforcreatingandmaintainingits
BusinessRecords,includingitsproceduresrelatingtothesaleandassignmentofconsumercreditaccounts.Original
Creditor'sBusinessRecordsweremadeintheregularcourseofbusinessanditwastheregularcourseofsuchbusinessto
maketheBusinessRecords.TheBusinessRecords weremadeatornearthetimeoftheeventsrecorded.Basedonmy
knowledgeofOriginalCreditor'sBusinessRecords,Ihavepersonalknowledgeofthefactssetforthinthisaffidavit.
3. CreditOneBankandConsumerwerepartiestoacreditagreement("Agreement").Consumeragreedto payCreditOne
Bankforallgoods,servicesandcashadvancesprovidedpursuanttotheAgreement.Thedateandtheamountofthelast
payment,ifany,madebyConsumeraresetforthinanexhibitattachedheretoandmadeaparthereof.Consumerdefaulted
andademandforpaymentwasmadebyCreditOneBank.AtrueandcorrectcopyofadocumentprovidedtoConsumer
evidencingthe Agreementis attachedasanexhibit to this
afEdavit.
4. AtthetimeofSale,Consumerowedtheamountsetforthintheexhibitsattachedheretoandmadeaparthemof,which
alsosetforththenameoftheConsumer;thelastfourdigitsofthe Accountnumber;thedateandamountofthecharge-off
balance;thedateandamountofthelastpayment,ifany·thetotalamounts,ifapplicable,ofanypost-charge-offinterestand
post-chargeofffeesandcharges;anypost-charge-offereditsorpaymentsmadebyoronbehalfoftheConsumer;andthe

ReceivablesservicedbyCreditOne.TheseBusinessRecordsaretransmittedtoFNBMandtoMHCinthenormalcourseof
CreditOne'sbusiness.BothFNBMandMHCaccepttheseBusinessRecordsasthebusinessrecordsofCreditOneand
incorporatedtheseBusinessRecordsintotheirown.

advancesprovidedpursuantthetermsandconditionsoftheAccount.AsshownintheBusinessRecords,theConsumer
failedtomakeallthepaymentsasrequiredbythetermsandconditionsoftheAccount.Underthetermsandconditionsof
theAccountreferencedbytheBusinessRecords,thefullbalanceundertheAccountwaschargedoffonll/26/2019witha
balanceimmediatelydueandowingof$1,568.38.
10. Onorabout12/17/2019(the"SaleDate"),M‰CandFNBM,asapplicable,soldapoolofcharged-offaccountsandtheir
associatedreceivablestoShermanOriginatormLLC("DebtBuyer").TheAccountwasincludedwithinthepoolsoldto
DebtBuyerontheSaleDate.IamnotawareofanyerrorsintheBusinessRecords,accountdocuments,oranyother
documentevidencingtheownershipandstatusoftheAccount.
11. FortheperiodfromtheOriginationDatetotheSaleDate,CreditOne,intheregularcourseofbusiness,causedperiodic
billingstatementstobedeliveredeachmonthtotheConsumer,unlesssuchstatementswerenotrequiredbylaw.Such
statementswereatrueandaccuratereflectionoftheBusinessRecordsandweresenteachmonthfromthedatetheAccount
wasopeneduntiltheSaleDate(otherthanwherenostatementmayhavebeenrequiredbylaw).
12. TheBusinessRecordsofCreditOneindicatethatasofthedatetheAccountwassold,therewasdueandpayableonthe
Accountof$1,568.38.Therecordsindicatethattberewerenouncreditedpaymentsagainstsuchamountatthetimeofsale.
13. TheBusinessRecordsofCreditOneindicatethatthelastpaymentreceivedontheAccountpriortotheSaleDatewas
postedtotheAccounton04/20/2019intheamountof$64.95.Theunpaidbalancedoesnotincludeanyinterestorfeesof
anykindaccruedorotherwisetotheCustomeraftertheCharge-offDate.
14. Pursuanttothe sale,bothMHCandFNBM,asapplicable,sold,transferred,assigned,conveyed,granted,bargained,setover
anddeliveredtoDebtBuyeranditssuccessorsandassigns,goodandmarketabletitletotheAccountandallassociated
unpaidReceivablesfreeandclearofanyencumbrance,lien,pledge,charge,claimorsecurityinterest.
15. InconnectionwiththesaleoftheAccount,BusinessRecords,includingbutnotlimitedtoelectNniccopiesofbilling
statements,weretransferredtoorotherwisemadeavailabletotheDebtBuyer(the"TransferredRecords").TheTransferred
RecordswerekeptbyCreditOne,MHC,and/orFNBMintheregularcourseofbusiness,anditwasintheregularcourseof
businessforanemployeeorrepresentativewithpersonalknowledgeoftheact,event,condition,oropinionrecorded:(i)
makememorandumorrecords;or(ii)totransmitinformationthereoftobeincludedinsuchmemorandumorrecords;and
(iii)thattherecordsbemadeatornearthetimeoftheactand/oreventrecordedorreasonablysoonthereafter.Tothe
