DEFENDANT. BUILDING ENVELOPE SYSTEMS. INC.'S MOTION FOR
EXTENSION OF TIME TO DISCLOSE EXPERT
Defendant, BUILDING ENVELOPE SYSTEMS, INC. ("BES"), by and through the
undersigned counsel, hereby files this Motion for Extension of Time to Disclose Expert
and states as follows:
1.
Undersigned counsel was recentlyretained to represent BES in this matter.
2.
Pursuant to the Court's Order dated December 13, 2021, the Defendants,
including BES, were required to disclose experts and provide expert reports by February
28,2022.
3.
Given our recent appearance in this matter, BES requiresadditional time to
provide the disclosure and report, and requests an opportunity to perform an inspection
within thirty(30) days and to disclose its expert's report within forty-five(45) days
thereafter.
4.
We have conferred with Plaintiff's counsel and they have no objections to
this extension as long it is does not impact the November 30,2022 discoverydeadline or
delay the February 2023 trial of this matter. This extension would not delay those dates.

No party would not be prejudiced by the granting of this Motion; however,
BES will be prejudicedif itis not permitted reasonable time to secure an expert and have
a report issued.

This Motion has not been brought for the purposes of delay,or any other
improper purpose, but rather has been brought in the interests ofjudicialeconomy.

I hereby certify
that the undersigned has conferred or attempted to confer
with all partieswho may be affected by the relief sought in the Motion in a good faith
effort to resolve the issues raised in the Motion, as more particularly
set forth in paragraph
4, above.
WHEREFORE, Defendant, BUILDING ENVELOPE SYSTEMS, INC., respectfully
requests entry of an order permitting an extension of time in which to disclose its expert
and provide an expert report, and for such other and further relief as this Court deems
proper and just.
