DEFAULT FINAL JUDGMENT
THIS CAUSE, having come before the Court on Plaintiff, TERESA J. MORRIS f/k/a TERESA
J. HENDERSON’s, Motion for Default Final Judgment against the Defendants, THE ESTATE OF
JAMES D. COOLEY, CRYSTAL STONE, heir to the Estate of James D. Cooley, and CODY
COOLEY, heir to the Estate of James D. Cooley (collectively the “Defendants”), and after
consideration of the aforementioned Motion, Affidavits, the Clerk’s Defaults entered on July 10, 2020,
and all evidence presented, it is hereupon:
ORDERED AND ADJUDGED as follows:
1. That Default Final Judgment be and the same is hereby entered in favor of Plaintiff and
against Defendants, for specific performance of the “Amended Agreement for Deed” dated September
9, 1998, for the real property at issue in this matter located in Marion County, Florida described as:
LOT 3, BLOCK D, RIDGEWOOD PARK, as recorded in Plat Book G,
page 13, of the Public Records of Marion County, Florida, having a street
address of: 801 NE 43“ Street Ocala, Florida 34479.

REC FEE INDEX2. Defendants shall facilitate the closing for the Property as follows:
a. Within 20 days of the Final Judgment, Defendants shall execute a warranty deed
transferring title to the Property to Plaintiff;
b. At or before the closing for the Property, Defendants pay all recording fees and
documentary stamps associated with the recording of the warranty deed for the
Property; and
c. At or before the closing for the Property, Defendants shall execute a satisfaction of the
Amended Agreement for Deed in addition to any other affidavits required by the title
commitment attached to Plaintiffs Motion.
3. Furthermore, Plaintiff, pursuant to Florida Statutes Section 57.041, is entitled to her
costs in the amount of One Thousand Two Hundred Fifty-Three and 35/100 ($1,253.35) Dollars, for
which let execution issue against Defendants.
4. The Court reserves ruling on Plaintiffs entitlement to her Attorney’s Fees against the
Defendants pursuant to the Amended Agreement for Deed.
5. This Final Judgment, in particular, the sums set forth herein, shall bear interest at the
statutory rate until fully satisfied.
6. Defendant, CODY COOLEY, as heir to the Estate of James D. Cooley, shall complete
under oath Florida Rule of Civil Procedure Form 1.977 (Fact Information Sheet), including all required
attachments, and serve it on T. Robert Shahady, Esq., Plaintiff's attorney, within forty-five (45) days
from the date of this Final Judgment, unless the Final Judgment is satisfied or post-judgment discovery
is stayed.
7. Defendant, CRYSTAL STONE, as heir to the Estate of James D. Cooley, shall complete
under oath Florida Rule of Civil Procedure Form 1.977 (Fact Information Sheet), including all required
attachments, and serve it on T. Robert Shahady, Esq.., Plaintiff's attorney, within forty-five (45) days

is stayed.
8. This Court reserves jurisdiction to enter further orders that are proper to compel the
Defendants to complete form 1.977, including all required attachments, and serve it on T. Robert
Shahady, Esq., Plaintiffs attorney, and all other post judgment orders which are just and proper.
