 MOTION TO DISMISS PLAINTIFF AMENED COMPLAINT
 Comes now the Defendant FOSTER MARINE CONTRACTORS, INC. hereafter FMC
 and moves that to this Court enter order dismissing Plaintiff Complaint and as grounds states the
 following:
 Plaintiff in paragraph 30 alleges that the Defendant FMC failed "to comply with the
 contract entered with the City of Ft. Lauderdale..,
 Plaintiff further alleges in paragraph 31 that they have breached their duty to the Plaintiff
 by "failingto comply with the contract entered into the City of Ft. Lauderdale."
