Admin, Rule 1.200, and Administrative Order 3.107. One hundred and fifty (150) days has passed and the Parties have not submitted an Agreed Case Management Plan with an Order Approving Case Management Plan within the time deadlines outlined in the administrative order and Rule 2.545. Fla. R. Jud. Admin. The Court having reviewed the file, it is ORDERED AND ADJUDGED that this a Non-Jury case and is designated to the STREAMLINE TRACK for time to disposition unless all defendant(s) have been defaulted and/or dropped. If all defendant(s) were defaulted or dropped then the Plaintiff will file the appropriate documentation to pursue a Default Final Judgment within 60 days from the date of this order and a Final Judgment to be entered or set for hearing within 90 days of the date of this order. It is if Defendant’s are not defaulted, this case will be resolved within 8 months from the date of this order and the following deadlines will be observed: EVENTS COMPLETION DATE Service of Complaint completed or extension by separate Order Amendments of pleadings Adding Parties April 4, 2022 Resolution of any motions that prevents the case from being at issue May 14, 2022 Fact and Expert discovery August 2, 2022 Deadline for Mediation August 2, 2022 Pretrial Motions September 1, 2022 Projected Date of Trial October 6, 2022 The deadlines established in this Case Management Order will be strictly enforced by the Court unless good cause is shown. Counsel is advised that the "Pretrial motion" deadline above includes, among other things, Daubert, Limine and Summary Judgment Motions. The deadlines in the Order Setting Trial and Directing Pretrial and Mediation Procedures will be dictated by the trial court's availability to try the case. The new deadlines set forth in the Order Setting Trial and Directing Pretrial and Mediation Procedures will prevail and supersede any deadlines set forth in this order. The Court directs the parties to set any outstanding motion(s) for hearing within 30 days from the date of this order. Failure to comply will result in the motion(s) being deemed abandoned without further hearing. Failure to comply with deadlines may subject the parties to sanctions, including but not limited to, striking of discovery, witnesses, evidence, pleadings, imposition of attorney fees, and/or dismissal. If any of the above time deadlines expire, the parties are directed to confer and discuss a timeline that will get the case back on track as soon as possible. You do not need a court order moving the deadlines as long as the case is ready for trial in the time period specified. Failure to cooperate may result in sanctions. It is FURTHER ORDERED AND ADJUDGED THAT A NOTICE FOR TRIAL IS REQUIRED. The parties are directed to file a Notice for Trial within 10 days of becoming at issue pursuant to Florida Rule of Civil Procedure 1.440. If this action is already at issue, parties are required to file a Notice for Trial forthwith. A trial order will be issued by the presiding Judge for a calendar call according to the differentiated case management plan unless otherwise requested on the Notice for Trial for an earlier setting.
