WHEREAS PLAINTIFFS and LENNAR wish to avoid the time and expense 25 involved with the adjudication of a Motion to Stay pursuant to Lennar’s Contractual Non- 26 Adversarial Dispute Resolution Procedures; 27 28 1708.697 / 9715411.1 -3- STIPULATION AND [PROPOSED] ORDER TO STAY ENTIRE ACTION 1 3. NOW THEREFORE, the Parties agree as follows: 2 A. This matter shall be stayed for all purposes, with the exception of 3 Section 3.C., pending Plaintiffs’ compliance with Lennar’s Contractual Non-Adversarial 4 Dispute Resolution Procedures. The stay shall remain in effect until the Parties agree to 5 lift the stay or until further order of the Court; 6 B. Neither Plaintiffs or Lennar waive any rights that either may have by 7 agreeing to this stay and either may seek the Court’s intervention to enforce Lennar’s 8 Contractual Non-Adversarial Dispute Resolution Procedures, as applicable, or lift the 9 stay, if necessary; 10 C. This stay shall not prevent the dismissal of any Plaintiff that needs to 11 be dismissed for any reason, including, but not limited to, non-compliance with Lennar’s 12 Contractual Non-Adversarial Dispute Resolution Procedures, previous participation in 13 another lawsuit relating to the same claims, and/or voluntary requests by the Plaintiff for 14 dismissal; and 15 D.
