issuance of a warrant to remove Defendants from possession of the premises, and, (b) any
other relief that the Court may deem just.
4. As set forth in the affidavit of the Petitioner in support of the Order to Show Cause annexed
hereto, it is necessary for this matter to have been submitted as an Emergency Order to
■ Show Cause since time is of the essence in that the Defendant, Jeanette Maldonado, has
assaulted, harassed, and threatened to kill the Plaintiff.
5. Specifically, Ms. Maldonado assaulted Petitioner on February 3, 2022, between 9.15 p.m.
and 9.52 p.m. at Petitioner’s home, 104-32 116 Street, Richmond Hill, New York, 11419,
(the “Premises”) County of Queens, State of New York. She hit Petitioner with a metal
bar.
6. The police was called to the scene and arrested the Defendant, Jeanette Maldonado, and
filed the charges against Ms. Maldonado, on 2/3/2022.
7. At the arraignment of the Defendant, Jeanette Maldonado, she was given a Limited Order
of Protection, allowing her to remain on the premises pending trial.
8. Upon her return to the premises, Ms. Maldonado, assaulted Petitioner again on 2/5/2022,
hitting Petitioner on her head. Again the Police were called.
9. Ms. Maldonado has also threatened to kill Petitioner and bum down the premises. This
was also reported to the Police.
10. Petitioner was constantly harassed by the Defendant after the Defendant was arrested and
arraigned, despite of the Court issuing an Order of Protection.
11. Fearing for her life, Petitioner has had to leave the premises with her two (2) year old infant
daughter and stay with relatives, several times.
12. Petitioner is still undergoing treatment for the assault.

13. Petitioner fears that the Defendant, Jeanette Maldonado, will retaliate more severely with
fatal results, once the criminal case against the Defendant goes to trial on May 10, 2022.
14. It is necessary for this matter to be treated as an Emergency Order to Show Cause given the
aforesaid as time is of the essence, and for the Landlord and family to have the quiet use and
enjoyment of their home that they sacrificed to purchase and maintain.
15. Petitioner is requesting a final judgment awarding her: (a) possession of the premises
with the issuance of a warrant to remove Defendants from possession of the premises;
and (b) Any other relief that the Court may deem just and proper.
16. This is the first time in this matter that Petitioner is making this application for relief from
the Court.
WHEREFORE, your affirmant respectfully requests that the within Order to Show Cause be
granted, awarding Petitioner possession of the Premises with issuance of a warrant to remove
Defendants from possession of the premises, and for such other and further relief that this Court
deems just, equitable and proper.

1. I am the Plaintiff in the entitled proceeding and I own the property located at 104-32 116
Street, Richmond Hill, New York, 11419.
2. I request that an Action for Declaratory Judgment by this Emergency Order to Show
Cause, be brought against my Tenants and all others who currently reside in the
apartment with them.
3. I have a good claim because: Ms. Maldonado assaulted me on February 3, 2022, between
9.15 p.m. and 9.52 p.m. at my home, 104-32 116 Street, Richmond Hill, New York,
11419, County of Queens, State of New York.
4. The police arrested her, and filed the charges against Ms. Maldonado, on 2/3/2022 (see
.Attach Exhibit 1).

6. Upon her return to the premises, Ms. Maldonado, assaulted me again on 2/5/2022, hitting
me in my head. Again the Police were called.
7. Ms. Maldonado has threatened to kill me and bum down my house, even after she
returned home. This was also reported to the Police.
8. Ms. Maldonado, has caused extensive damage to the premises before and after the
assault.
9. The Criminal case for Ms. Maldonado, has a next Court appearance date of May 10,
2022. I am terribly scared and afraid of her and of what she and her co-tenants would do
after this date to me and my family in my own home.
10. My husband was also attacked by the brother of Ms. Maldonado, Jaime Delgado or Jaime
Maldonado, both names given for the same individual, on or around June 2020. The
brother had an Order of Protection that kept him away from the premises for a year,
which ended in July 2021, after which he frequently stays over in the premises, (See
attached Exhibit 3).
11.1 am afraid to be in my home, I am afraid for my family, which includes my two (2) year
old daughter, and my husband.
12.1 am proceeding by Emergency Order to Show Cause rather than by notice of petition
because the Defendant Jeanette Maldonado, my tenant, has assaulted me, the Plaintiff and
Landlord, Bibi Fazika Haroof, and is awaiting trial on May 10, 2022.
13. Again, the Defendant has made threats to me, that she will kill the me and bum the house
down. And I am in fear of further assault against myself and my family, after her trial, if not
fatal injury.
14.1 am requesting a final judgment awarding me (a) possession of the premises with the
issuance of a warrant to remove Defendants from possession of the premises
And, (b) Any other relief that the Court may grant.
15.1 share in all of my attorney’s arguments and requests, as if made herein.
This is the.first time that I am making this application for relief from the Court in this
Matter.

Specifically, Ms. Maldonado assaulted Petitioner on February 3, 2022, between 9.15 p.m. and 9.52 p.m. at Petitioner’s home, 104-32 116 Street, Richmond Hill, New York, 11419, (the “Premises”) County of Queens, State of New York. She hit Petitioner with a metal bar. 6. The police was called to the scene and arrested the Defendant, Jeanette Maldonado, and filed the charges against Ms. Maldonado, on 2/3/2022. 7. At the arraignment of the Defendant, Jeanette Maldonado, she was given a Limited Order of Protection, allowing her to remain on the premises pending trial. 8. Upon her return to the premises, Ms. Maldonado, assaulted Petitioner again on 2/5/2022, hitting Petitioner on her head. Again the Police were called. 9. Ms. Maldonado has also threatened to kill Petitioner and bum down the premises. This was also reported to the Police. 10. Petitioner was constantly harassed by the Defendant after the Defendant was arrested and arraigned, despite of the Court issuing an Order of Protection. 11. Fearing for her life, Petitioner has had to leave the premises with her two (2) year old infant daughter and stay with relatives, several times. 12. Petitioner is still undergoing treatment for the assault. I am terribly scared and afraid of her and of what she and her co-tenants would do after this date to me and my family in my own home. 10. My husband was also attacked by the brother of Ms. Maldonado, Jaime Delgado or Jaime Maldonado, both names given for the same individual, on or around June 2020. The brother had an Order of Protection that kept him away from the premises for a year, which ended in July 2021, after which he frequently stays over in the premises, (See attached Exhibit 3). 11.1 am afraid to be in my home, I am afraid for my family, which includes my two (2) year old daughter, and my husband. 12.1 am proceeding by Emergency Order to Show Cause rather than by notice of petition because the Defendant Jeanette Maldonado, my tenant, has assaulted me, the Plaintiff and Landlord, Bibi Fazika Haroof, and is awaiting trial on May 10, 2022. 13.
