performance in regards to the valid and binding written Contract of Sale dated January 3,

2023, between Plaintiff (and Avital Vahab) as Purchaser and Defendant as Seller for the

Subject Premises known as and located at 520 East 72nd Street, Unit 12D, New York, NY

10021 (the “Contract”).

The Contract, while naming Avital Vahab (“Avital”) as a Purchaser along with Plaintiff,

was never signed by Avital and only executed by Plaintiff and Defendant on January 3,

2023.

The Subject Premises is a Unit within a Cooperative Building owned by 520 East 72nd

Street Owners Corp.(the “Co-op”) and contains the purchase of 928 shares that are

allocated to the Subject Premises (the “Co-op Shares”).
