xxxxx xxxxxx v. xxxxxx D. xxxxxx, The Law Offices Of xxxxxx D. xxxxxx, P.C.

Plaintiff brings this action for damages for legal malpractice against her former lawyer,

xxxxxx D. xxxxxx of the Law Offices of xxxxxx D. xxxxxx, P.C. (“Defendant”) (together with

Plaintiff, the “Parties”) based on Defendant’s violations of New York Lawyer’s Code of

Professional Responsibility and for breach of duty including breach of fiduciary duty, negligence,

and negligent infliction of emotional distress. Those acts were committed in a divorce proceeding

commenced by Plaintiff, as xxxxxx v. Pearce, Index No. 308611/15, in the Supreme Court of the

State of New York, New York County, which matter was presided over by the Hon. Matthew F.

Cooper, and the subsequent appeal in the Appellate Division, First Department (the “Divorce

Matter”). The parties in the Divorce Matter were the current Plaintiff and Christopher Pearce (the

“Divorce Defendant”) (together with Plaintiff, the “Divorce Parties”).
