Overview
This Class Action, brought by Named Plaintiff on behalf of herself and other
similarly situated individuals who performed work for U-Haul International Inc., William Wolf,
and other related entities and individuals (collectively “U-Haul” or “Defendant”), challenging U-
haul’s practices and policies of misclassifying Plaintiffs and other similarly-situated workers as
“exempt” employees, and not paying them all compensation in violation of the New York Labor
Law (“NYLL”) and implementing regulations. Plaintiffs specifically allege violations of unpaid
wages and improper notice of wages under Article 6, Article 19, and the Miscellaneous Wage
Order (12 NYCRR Part 142).
U-Haul requires its “managers” to spend nearly all of their time performing the
same menial tasks performed by the company’s non-exempt, hourly workers, for example
answering phones, recovering vehicles, cleaning vehicles and store locations, scheduling
reservations, helping customers, and cleaning.
In actuality, these labeled “managers” lack any independent authority, and
exercise little to no discretion over their job functions. The managers did not have authority over
